The Australian Human Rights Commission submitted an inquiry report late on Wednesday night. The report comes with the recommendation of a royal commission.

The royal commission has to examine the impact on hundreds of children being detained for long periods in immigration detention centres. The report, called “The Forgotten Children,” also asked for the release of all the children from mainland detention and from the detention centre on Nauru. The commission examined hundreds of incidents of child abuse that included more than 30 cases of sexual assault as well. The report was then submitted to the Australian government on Nov. 11.

The report happens to be the largest survey ever conducted in the world involving children in detention. There were 1129 children whom the inquiry staff interviewed in a period of more than 15 months. The interview period spanned both the Labor and Coalition governments and went on from January 2013 to March 2014.

According to reports, there were 233 recorded cases of child abuse and 33 cases of reported sexual assault, the Sydney Morning Herald reports. The royal commission is going to examine “the use of force by the Commonwealth against children in detention and allegations of sexual assault against these children.”

The report has asked 119 children on Nauru to be removed into the Australian community. The report notes that children who are detained indefinitely on Naaru have been “suffering from extreme levels of physical, emotional, psychological and developmental distress.”….

Indigenous children were beaten, sexually assaulted, stripped and chained to beds, and forced to eat their own vomit, it has been alleged at the royal commission into institutional responses to child sexual abuse on Monday.

The 17th public hearing of the royal commission began hearing from members of the stolen generations who say they were sexually abused at a Darwin home.

It’s examining how the government and administrators responded to the allegations of child sexual abuse by employees at the Retta Dixon home between 1946 and 1980, when it closed.

Retta Dixon was one of the main government-run homes for children of mixed Aboriginal and non-Aboriginal descent forcibly removed from their families. Established by Christian missionaries in the 1930s, it also housed unmarried mothers and their babies, and temporary visitors. At its peak it held 120 people, according to the federal government’s 1997 Bringing Them Home report….

It is the first time the commission has held a hearing in the Northern Territory. It is also the first public hearing to predominantly involve Indigenous people.

A number of Aboriginal women gave evidence at the inquiry into the Parramatta Girls Home and Hay Institute.

Of all the people who have contacted the commission, 827 (18%) are Indigenous, the chief commissioner, Peter McClellan, said as he opened the public hearing on Monday morning.

He added that 9% of people coming to private sessions are from Aboriginal communities.

The inquiry into the Retta Dixon home is expected to run for about two weeks.

….When the Australian federal government announced the establishment of a Royal Commission in late 2012 into Institutional Responses to Child Sexual Abuse, Cardinal Pell also caused controversy when he stated that priests who hear confessions from people who commit child sex abuse must remain bound by the Seal of Confession.

‘If that is done outside the confessional (it can be reported to the police)…. (But) the Seal of Confession is inviolable. If the priest knows beforehand about such a situation, the priest should refuse to hear the confession… That would be my advice, and I would never hear the confession of a priest who is suspected of such a thing,’ he said.

On Thursday the Vatican also refused to hand over the files of Australian priests accused of sex crimes to the child abuse royal commission.

The Vatican said the commission’s request for documents on each allegation involving an Australian cleric was ‘neither possible nor appropriate’.

Reasons included ongoing church investigations, and that internal working documents were the sovereign property of the Holy See….

The Catholic Church is no more legally responsible for priests who abuse children than a trucking company which employs a driver who molests women, Cardinal George Pell maintains.

Victims’ families say it’s a ludicrous comparison and even the chair of the child abuse royal commission thinks the situation is quite different when it comes to a priest getting access to a child.

Cardinal Pell accepts the church has a moral obligation to victims, but when it comes to its legal responsibility, the actions of its priests are not necessarily its fault.

‘If the truck driver picks up some lady and then molests her, I don’t think it’s appropriate, because it is contrary to the policy, for the ownership, the leadership of that company to be held responsible,’ Cardinal Pell told the commission via video link from Rome on Thursday.

But Cardinal Pell said if the church had been warned about a priest or had bad policies or procedures in place, ‘then certainly the church official would be responsible’….

Commission chair Justice Peter McClellan said priests got access to children with the parents’ consent, unlike truck drivers.

‘The relationship between the priest and a child is quite different to that between the truck driver and the casual passenger, isn’t it?’ he asked Cardinal Pell.

‘Yes, I would certainly concede that,’ Cardinal Pell responded….

Cardinal George Pell’s role in setting up a Catholic Church compensation scheme for victims of pedophile priests will be scrutinised on Thursday at the child abuse royal commission.

Pell was archbishop of Melbourne in 1996 when the Melbourne archdiocese decided to respond to growing allegations of child sex abuse by its clergy. The church considered creating a legal entity that could be sued by victims, but designed the Melbourne Response compensation scheme instead.

Cardinal Pell told the royal commission earlier this year he believed the church should now create an entity that could be sued.

A Victorian parliamentary inquiry last year recommended the Catholic Church be incorporated so it could be sued….

The man in charge of the Catholic Church’s so-called Melbourne Response to allegations of child abuse has rejected suggestions he failed to encourage victims to go to police.

Peter O’Callaghan QC has been dealing with complainants and deciding whether they are eligible for compensation since the scheme began in 1996.

He was repeatedly questioned about the legal integrity of his decision-making at today’s hearing of the Royal Commission into Institutional Responses to Child Sexual Abuse.

Mr O’Callaghan has been a Queen’s Counsel for 40 years and said the Melbourne Response was based in canon law and “natural justice”.

He said when there was a dispute with a claim he would take on a role similar to a magistrate in a criminal case.

He was again asked repeatedly why he did not report cases of abuse to Victoria Police and why he took it upon himself to advise victims on the potential strength of their cases….

Yesterday he told the commission he had made more than 330 adverse findings against priests within the Melbourne archdiocese since the complaint’s procedure began.

The church has paid out more than $17 million to abuse victims through the scheme.

But victims were told if they chose to go to police, they were no longer eligible for compensation….

Forty years later in 2006 the man giving evidence read an article by Tommy Campion, another former resident of the North Coast Children’s Home….

In the 1980s he had been diagnosed with depression and attempted suicide several times. He now had leukaemia. In broken voice he told of beatings that left him scarred; of being left at a table for ten hours because he could not eat the food. If he threw up he would be made to eat the vomit.

A priest who seemed kind made him lie naked while he performed a pseudo-religious ritual that involved molesting him sexually….

His life has been no life just like many among the thousands of people who are coming forward to tell their stories – often for the first time….

Children of abuse survivors are learning for the first time why their mum or dad could never hug them. A landscape of broken lives, failed relationships, drug use, anger, suicides, bravery and extraordinary honesty while people struggle still for happiness is being painted by these witnesses.

Preparing for and giving evidence is a renewed trauma and the commission always has counsellors on hand to help them through.

Institutions, the Christian and Marist brothers, the Salvation Army, Catholic and Anglican dioceses, the YMCA, Scouts Australia, state run child-protection agencies and police forces across the country are trying to explain how it happened on their watch.

When a Salvation Army witness started to say how different standards of child discipline in the 1960s and `70s might explain why boys were beaten until they bled in homes in NSW and Queensland, commission chair Justice Peter McClellan interrupted to remind her she was talking about criminal assaults.

Brand protection, systemic failures, wilful ignorances, whether it be in the YMCA, the Scouts or the Catholic Church are being uncovered daily at these hearings.

The Catholic and Anglican churches moved abusers when complaints were made.

They kept no records that can now be produced.

In the case of the Marist Brothers, a man who was jailed for 12 years in 2006 was put on a plane to a clinic for sex-offending priests in Canada three days after the order knew police were investigating him for offences dating back years….

(CNN) — An Australian commission is hearing allegations of the physical and sexual abuse of boys in the care of the Salvation Army over several decades.

The shocking treatment at some of the organization’s boys homes included rape, beatings, locking boys in cages and, in one case, forcing a boy to eat his own vomit, the commission was told Tuesday.

The public hearings, taking place in Sydney, are part of a wide-ranging investigation into how Australian institutions responded to cases of child sexual abuse.

The current phase is focusing on the Salvation Army’s response to abuse that took place in four of its boys homes in the states of Queensland and New South Wales in the 1960s and ’70s….

The Salvation Army isn’t denying the abuse, which came to light previously. It has apologized, admitting that hundreds of boys suffered in its care….

Those who did complain weren’t generally taken seriously.

“In cases when abuse was reported, the boys were often disbelieved and were punished for reporting what were characterized as ‘lies,'” he told the hearing….

A priest told a former resident of a church-run children’s home in Northern Ireland that he was the product of an evil and satanic relationship, an inquiry has heard.

The son of an unmarried mother said he became a zombie, introverted and fearing the next beating, lying soaked in urine at night in an attempt to dissuade any sexual abusers from “dropping the hand”.

He was a resident at St Joseph’s in Termonbacca, Londonderry, run by the Sisters of Nazareth order of nuns, in the 1950s and complained about his treatment to a priest after leaving the home.

The response was: “You must never speak about this, you must understand… you and the other orphans are bastards. You are the product of an evil and satanic relationship. You never had a chance.”….

“I have waited 65 years to say this. When I was reared by the Sisters of the Congregation of Nazareth it was equivalent to being reared by the Taliban, such was their sadism, their lack of empathy, their fundamentalism, their lack of dignity to the little helpless boy.”

He ran away and was recovered time after time.

One nun smirked and said: “Welcome back, your majesty,” the witness said.

“Then the beatings would start.”….

The Catholic Archbishop of Brisbane, Mark Coleridge, says members of the clergy were caught like “rabbits in a headlight” when a pastoral and redress scheme for victims of child sexual abuse was first rolled out.

The Royal Commission into Institutional Responses to Child Sexual Abuse is examining the Towards Healing process established by the Catholic Church in 1996….

A CATHOLIC priest ran a cult-like group sexually abusing young girls giving them all the surname Brown, as in Charlie Brown from the Peanuts comic strip, the royal commission has been told.

Her voice wavering, one member of the group, Joan Isaacs, said Father Francis Derriman told her he was dying and had to have sex with her first.

He fathered a child with another girl in the group when she was 17.

Ms Isaacs said: “Frank Derriman used the Peanut comic as a platform and used the surname Brown in reference to himself, the other three children and me.”

At the time in 1967 and 1968, Father Derriman was a priest with the Archdiocese of Brisbane and chaplain of Sacred Heart Sandgate in Brisbane, she told the commission.

After two committals and trial, Father Derriman was in 1998 eventually convicted of sexually abusing Mrs Isaacs, now aged 60, and sentenced to one year behind bars, to be suspended after he served just six months.

“Father Derriman created a cult like group which included myself and three other children,” Mrs Isaacs, 60, said….

“I have maintained friendships with the other three children in the Brown group. The two girls out of the group have told me that Frank Derriman also sexually abused them. One of them took steps to have him criminally charged in respect of her sexual abuse and the other girl fathered Frank Derriman’s child at the age 17 years.”….

Mrs Isaacs said she later went through the Catholic Church’s Towards Healing process expecting to be treated with warmth, dignity and respect but later discovered that everything that was said to her during the process, including the apology, had been drafted by a church lawyer beforehand.

Reluctantly she ended up signing a deed of release with the church that banned her from discussing what happened to her, including the Towards Healing process, with anyone including her husband or to make “disparaging remarks” about the church.

She received enough compensation to buy $5000 worth of Coles-Myer shares and a sewing machine….

She said she had felt silenced for the past 12 years since signing the confidentiality agreement with the church. The royal commission has negotiated with the church to lift all those suppression agreements….

‘Satan made me’: NSW nursing home murderer May 27, 2013

A registered nurse has become the worst mass murderer in New South Wales history, pleading guilty today to killing 11 elderly residents. Their nurse, Roger Dean….
On the first day of his Supreme Court trial on Monday, Dean, 37, pleaded guilty to the murders of 11 elderly residents who died as a result of the fires he lit at the home on November 18, 2011.

He also admitted to causing grievous bodily harm to a further eight residents who were injured in the blaze, described by paramedics and firefighters as one of the worst scenes they had ever come across.

According to crown documents, the registered nurse had stolen more than 200 pills from the nursing home the night before and police officers were called to the home during his November 18 night shift to investigate the theft….
He was arrested and charged later that evening, telling police, “It was Satan telling him to do it”.

As Dean stood up in court and softly said “guilty” to the 11 counts of murder, his victims’ families wept and one woman left court sobbing loudly….

Fear has gripped residents of Ahanta West District in the Western Region over suspected ritual murders of four innocent citizens in the area.

The victims were gruesomely murdered with parts of their body removed, and their corpses badly mutilated in what looks like a ritual murder.

The District Chief Executive (DCE) for the area, Mr. Joseph Dofoyenah, told the Ghana News Agency in an interview that the strange deaths had occurred within a period of three months.

A FATHER winning custody of a daughter despite evidence he had sexually abused the toddler was just one of the cases warranting the Family Court’s inclusion in the Royal Commission into Child Sexual Abuse, an advocacy group says.

Child sexual assault victims will suffer on in silence unless the Family Law Court is investigated by the Royal Commission, according to child protection advocate Hetty Johnston.

The founder and executive director of Bravehearts says the inquiry contains a glaring omission in its terms of reference.

The Family Law Court often hears disturbing allegations of sexual abuse.

“Every week in Australia the family courts are ordering children into contact with, and even into the custody of parents who are dangerous, toxic and abusive because Family Courts do not have the powers, expertise and resources to competently investigate allegations of child abuse,” Ms Johnston said….

Study Name and citation:
Loftus, E. & Pickrell, J. E. (1995). The Formation of False Memories. Psychiatric Annals, 25(12), 720-725.
(Commonly known as the “Lost in the Mall” study).

Theory Advanced by the Study:
False childhood memories can be implanted into adults by repeatedly stating the false memory as true.

Conclusion: The study’s theory and methodology are not reliable under either Frye or Daubert standards.

Overarching Observation: Irrespective of scientific reliability, no study should be admitted as evidence in a court of law, whether directly or via the testimony of an expert relying on that study, unless it is relevant to an issue legitimately in dispute in a particular legal controversy.

Relevancy standards applicable to scientific and “specialized” testimony and evidence refer to this as the “fitness” factor, which means the proposed evidence “fits” the facts because it will help to elucidate the truth on a disputed issue. For example, any attempt to use the Lost in the Mall  study to prove or disprove that a person is telling the truth about sexual abuse should be unsuccessful simply because memories about getting lost in a mall have nothing to do with memories of being sexually or physically violated.

Put another way, the capacity to make a person falsely believe they were once lost in a mall does not “fit” and bears no relevance in a dispute over whether a person can be made to falsely believe they were sexually abused as a child. This argument should be made first, before addressing more complicated scientific arguments about how the “Lost in the Mall” study was designed a nd conducted. It should be made clear to the judge that if a particular study, or proposed expert testimony relying on that study, is not relevant because it does not “fit” with the facts in dispute, there is no need to undertake a burdensome analysis of whether scientific standards were satisfied during the research process. Simply put, if it isn’t relevant, it doesn’t matter that a study is
scientifically unreliable.

Detectives are investigating allegations of widespread child sex abuse at schools run by a Catholic order in Britain, the Sunday People reveals today.
The Metropolitan Police paedophile unit will quiz around 20 priests and teachers over claims of abuse dating back to the 1950s.

Thirty former pupils from schools run by the Salesians of Don Bosco order have come forward with allegations, an investigation by Exaro, the news website, with the Sunday People found. New BBC boss apologises for Jimmy Savile on his first day in the job

NEW BBC director general Tony Hall yesterday admitted the BBC dropped the ball over the Jimmy Savile scandal….

Speaking on his first day in the job, Lord Hall, 62, said: “I feel very sorry for the organisation but also for those who were victims of Jimmy Savile.

“Today is about creating a sense of what the BBC wants to be going forward, absolutely learning those lessons, not forgetting that history.”….

He replaces George Entwistle, who quit after 54 days when he failed to get a grip on the Savile row.

Royal Commission begins 3 April, 2013

For victims of institutional abuse it was a long time coming, but the Royal Commission into Institutional Responses to Child Abuse has finally arrived, with the first hearing to be held this morning.

The first public sitting of the Commission can be seen via webstream at the Royal Commission’s website from 10am.

Today’s sitting won’t hear any evidence but is expected to explain the work of the Royal Commission so far, and provide more details of future hearings with all six commissioners present.

The Catholic Church will be among the groups investigated by the Royal Commission….
