Sargent earned an uncritical mention in the “Legal Corner” section of this FMS. newsletter….after he successfully appealed his criminal conviction for sexually assaulting his two minor step-children and one of their friends. See, State v. Sargent (1999). The court ruled that Sargent should have been allowed to present a “false memory” expert to the jury. But the FMS. never reported the rest of the story.

Sargent was convicted by a jury after a second trial that included a “false memory” expert for the defense. That conviction was upheld by the New Hampshire Supreme Court….But the second appellate decision, State v. Sargent (2002), was never mentioned in the FMS. newsletter. Neither were the remarkable events that unfolded after his second trial.

Before being sentenced, Sargent admitted that his “false memory” defense was a ruse. He confessed his guilt, apologized to the children, and, as reported by the Associated Press, told the judge: “I wasn’t in denial for what I had done, but I just didn’t want to pay the consequences.” Judge Smukler, mindful of the fact that Sargent put three children through two separate trials before admitting the truth, sentenced him to 21 to 54 years in prison.

Stepfather confesses to child molestation LACONIA, N.H. AP 7/6/00
After five years of denying he raped his two stepchildren and one of their friends, Wayne Sargent Jr. admitted to the crimes Wednesday. Sargent, 33, was convicted in Belknap County Superior Court in May on nine counts of aggravated felonious sexual assault and felonious sexual assault for molesting the children between 1995 and 1996. He had been convicted in 1997 for the same crimes and sentenced to 21 to 54 years in prison.

But the state Supreme Court overturned the verdict last year because Judge Larry Smukler did not allow a defense expert to testify about how
“false memories” can be implanted in children through suggestive questioning. At Sargent’s sentencing Wednesday, Smukler handed down the same sentence – 21 to 54 years in prison.

Paedophile ring leader Colin Blanchard jailed 10 January 2011
The leader of a paedophile ring which sexually abused young children and shared the images has been jailed. Colin Blanchard, 40, of Rochdale, admitted a string of sex offences. He received an indeterminate sentence and must spend at least nine years in jail.

Two women were also sentenced. Tracy Lyons, 41, of Portsmouth, was jailed for seven years and Tracy Dawber, 44, of Southport, for four years. Plymouth nursery worker Vanessa George, 40, was jailed in 2009. http://www.bbc.co.uk/news/uk-england-manchester-12143586

Many viewers leave the theater believing that they have seen an objective documentary presented by a director who entrusted audiences to draw their own conclusions on Arnold Friedman’s and Jesse Friedman’s guilt. A careful review of the original evidence, however, shows that the case against the Friedmans was much stronger than the film revealed.

He tells how he and Jesse made a special trip to Wisconsin to visit Arnold Friedman in prison to convince him to reveal where he had hidden the photos and videos of the children. Arnold refused to reveal what he had done with them, despite the fact that it would have helped gain lenacy for his son….Frances Galasso, the detective-sergeant who was in charge of the Friedman case, describes Jesse’s lack of remorse for his victims and describes how he and his brother harassed some of the victims’ parents at court proceedings. He threatened to burn their houses down. He reportedly said he would kill their parents. . . . Some of the children who testified before the grand juries received threatening telephone calls warning them not to cooperate with police.”

June 28, 1990 The Supreme Court of New York responds affirmatively to an appeal by Ross Goldstein who asks the state to reduce his sentence to the terms recommended and agreed to by the prosecution. Although he was not mentioned in the film, Mr. Goldstein was a third defendant who was arrested along with Arnold and Jesse Friedman. According to this document, Goldstein, a former friend of Jesse’s who was between 15 and 16 years old when he committed the crimes. He later became repulsed by the abuse, and six months before the Friedmans were arrested, Goldstein disassociated himself from Jesse Friedman and his activities. Goldstein, now age 19, confessed to the crimes and agreed to testify against both Arnold and Jesse Friedman in exchange for leniency.

Victims break their silence  Victor Manuel Ramos — Newsday  — LI., NY     February 29, 2004 Newsday  staff reporter Victor Manuel Ramos interviews several of the victims who Arnold and Jesse Friedman plead guilty to abusing.

“For Gregory, the hullabaloo over Jarecki’s film — and whether the director will pick up an Oscar tonight — is a sideshow to the legacy of the abuse. Even now, Gregory said he sometimes wakes up at night shaking, especially after hearing of other child abuse cases on the news or elsewhere. What would be passing news to others, hits home for him.
Diagnosed in his preteen years, Gregory said he has persistent rectal bleeding from the abuse. Memories aside, the physical scar will never let him forget. `This is the constant reminder I live with every day,’ Gregory said, `that I was abused.'”

Our research into the case shows that the director of the film sacrificed truth in favor of creating artistic ambiguity. Clear evidence is omitted and facts are distorted. In addition, the film relies on popular but erroneous myths about child sexual abuse. As a result, uncertainty is created about the guilt of two confessed pedophiles — who are recast as victims — while the real victims — the boys and their families — are portrayed as untrustworthy.

April 15, 2010 VATICAN CITY (Reuters) – A Vatican cardinal in charge of clergy around the world congratulated a French bishop in a 2001 letter for not denouncing a sexually abusive priest to the police, according to a French website on Thursday. The letter posted by Golias, a critical lay Roman Catholic magazine based in Lyon, is the most explicit of a wave of recently published internal church  documents in showing past Vatican encouragement to cover up sexual abuse by priests. In the letter dated Sept 8, 2001, Cardinal Dario Castrillon Hoyos backed French Bishop Pierre Pican’s decision not to denounce a priest who was later sentenced to 18 years in jail for repeated rape of a boy and sexual assaults on 10 others.

Under fire in recent weeks for its secretive handling of abuse cases, the Vatican has insisted the fact that other published documents did not explicitly instruct bishops to inform police of abuse did not prove it told them to hide it….Pican, who received a suspended three-month jail sentence for not denouncing sexual abuse of minors, admitted in court he had kept Rev. Rene Bissey in parish work despite the fact the priest had privately admitted committing pedophile acts.

The case shocked France and prompted its bishops to declare that all abuse cases must be reported to civil authorities. “I congratulate you for not denouncing a priest to the civil administration,” Castrillon Hoyos said. “You have acted well and I am pleased to have a colleague in the episcopate who, in the eyes of history and of all other bishops in the world, preferred prison to denouncing his son and priest.”  http://abcnews.go.com/US/wireStory?id=10388243
