Top private schools included as part of Scottish child abuse inquiry


Inquiry chair Lady Smith has said more than 100 locations so far have been identified for investigation, including current and former boarding schools

More than 60 residential care establishments including several top private schools are being investigated by Scotland’s national child abuse inquiry.

They are among more than 100 locations where the abuse of children is said to have taken place, chair Anne Smith confirmed.

Six boarding schools or former boarding schools, including Fettes college and Gordonstoun, are being investigated. Several faith-based organisations, other major care providers and local authority institutions are also being looked at by inquiry staff.

Lady Smith, a senior judge who was appointed to the role in July, named a list of places being investigated as she provided an update on the inquiry’s progress at a preliminary hearing.

The inquiry is examining historical allegations of the abuse of children in care and has been taking statements from witnesses since last spring….

Archbishop admits Church ‘failed terribly’ over abuse revelations

The Church of England has tonight apologised unreservedly after a Channel 4 News investigation revealed that a prominent Anglican evangelical and former colleague of the Archbishop of Canterbury is alleged to have severely assaulted boys and young men for decades.

The alleged abuse was carried out by prominent QC and part time judge called John Smyth, who was chairman of the Iwerne Trust, a charity closely linked to the church which ran Christian holiday camps for public school students.

The Church admitted that it had “failed terribly”, after this programme learned that the Trust had discovered the alleged abuse in 1982, but failed to report it to the police.

Winchester College, where some of the young men met Smyth, was made aware of the alleged abuse, but also failed to report it to the police at the time. There is no suggestion that any abuse took place at the College or with the knowledge of its staff.

The Archbishop’s apology comes after a six month investigation by Channel 4 News, in which we tracked down and spoke with many of Smyth’s alleged victims. One man told us that he and other boys were beaten so violently by Smyth that they had to wear nappies to staunch the bleeding….

It described what it called the “beatings” of 22 young men.

“The scale and severity of the practice was horrific…8 received about 14 thousand strokes: 2 of them having some 8000 strokes over three years,” the document, written in 1982, noted.

Despite the findings of the report, the Iwerne Trust did not inform the police. Instead, a senior figure in the Iwerne Trust wrote to John Smyth, telling him to leave the country. He went on to live in Zimbabwe, and then South Africa….

….When the Australian federal government announced the establishment of a Royal Commission in late 2012 into Institutional Responses to Child Sexual Abuse, Cardinal Pell also caused controversy when he stated that priests who hear confessions from people who commit child sex abuse must remain bound by the Seal of Confession.

‘If that is done outside the confessional (it can be reported to the police)…. (But) the Seal of Confession is inviolable. If the priest knows beforehand about such a situation, the priest should refuse to hear the confession… That would be my advice, and I would never hear the confession of a priest who is suspected of such a thing,’ he said.

On Thursday the Vatican also refused to hand over the files of Australian priests accused of sex crimes to the child abuse royal commission.

The Vatican said the commission’s request for documents on each allegation involving an Australian cleric was ‘neither possible nor appropriate’.

Reasons included ongoing church investigations, and that internal working documents were the sovereign property of the Holy See….

The Catholic Church is no more legally responsible for priests who abuse children than a trucking company which employs a driver who molests women, Cardinal George Pell maintains.

Victims’ families say it’s a ludicrous comparison and even the chair of the child abuse royal commission thinks the situation is quite different when it comes to a priest getting access to a child.

Cardinal Pell accepts the church has a moral obligation to victims, but when it comes to its legal responsibility, the actions of its priests are not necessarily its fault.

‘If the truck driver picks up some lady and then molests her, I don’t think it’s appropriate, because it is contrary to the policy, for the ownership, the leadership of that company to be held responsible,’ Cardinal Pell told the commission via video link from Rome on Thursday.

But Cardinal Pell said if the church had been warned about a priest or had bad policies or procedures in place, ‘then certainly the church official would be responsible’….

Commission chair Justice Peter McClellan said priests got access to children with the parents’ consent, unlike truck drivers.

‘The relationship between the priest and a child is quite different to that between the truck driver and the casual passenger, isn’t it?’ he asked Cardinal Pell.

‘Yes, I would certainly concede that,’ Cardinal Pell responded….

More than 600 suspected paedophiles, including doctors and teachers, have been arrested across Britain after a six-month investigation led by the National Crime Agency.

The agency, dubbed Britain’s FBI, announced on Wednesday it had arrested 660 suspected child abusers and taken more than 400 children into care in the first nationwide investigation of its kind.

Of the 660 arrested, 39 were registered sex offenders but the vast majority of suspected paedophiles were off the police’s radar. Those arrested include doctors, teachers, scout leaders, care workers and former police officers.

The operation, which had remained secret until Wednesday, targeted people accessing indecent images of children online….

One of those arrested and subsequently charged was a doctor who allegedly kept more than 1m images of child abuse on his computers and had arranged to meet boys….

A senior detective investigating sex abuse claims against Cyril Smith told the force there was prima facie evidence of the late MP’s guilt in 1970 – but this claim was overruled, newly released documents show.

The detective’s report in 1970 to the chief constable of Lancashire said the Liberal MP would have been “at the mercy of a competent counsel”.

The 14-page report also revealed “veiled threats” from a friend of Smith, thought to be a fellow senior Liberal. The director of public prosecution later advised against prosecuting. Smith died in 2010 aged 82.

The documents were released on Wednesday night by the Crown Prosecution Service following a ruling by the information rights tribunal.

Simon Danczuk, the Rochdale Labour MP, who first named Smith as a child abuser, said that the documents were another indication of the cover-up that had protected Smith from being disclosed as a paedophile.

“This shows that police officers were certain of his guilt,” Danczuk said. “If they had been allowed to do their job they would have saved many more boys from being abused. We know that Cyril went on to abuse many more boys at Knowl View residential school, Elm guest house, and other places, during the 70s and 80s.”….

Santa Rosa diocese pays $3.5 million to settle sex abuse case

The Roman Catholic Diocese of Santa Rosa has paid $3.5 million to a teenager who was molested by a Lakeport priest, one of the largest settlements paid out by the North Coast diocese in a series of sexual abuse cases that spanned more than two decades.

An attorney for the victim attributed the settlement’s size partly to the church’s failure to protect children from the Rev. Ted Oswald, even though it was aware he had abused others. Oswald molested the boy, then 12, in 2010, the same year the priest died, with some of the incidents taking place in the Lakeport parish church.

“But for the diocese’s actions, it is entirely possible that this 12-year-old boy would never have been molested,” said Skye Daley, the victim’s attorney.

Bishop Robert F. Vasa, who has led the diocese since 2011, was on vacation Tuesday and unavailable for comment. Diocese spokesman Brian O’Neel rejected Daley’s assertion.

“When the diocese became aware of this most recent allegation, they removed Father Oswald from ministry and reported the situation to civil authorities,” O’Neel said. “The diocese could not do more than the civil authorities could.”….

In a statement, Vasa apologized to the boy and other victims who suffered at the hands of pedophiles in the church.

“I humbly apologize to this young person on behalf of the Church that failed to protect them. I also take this occasion to apologize to all victims for the harm done to them. This perversity, though prevalent in all parts of society, was allowed to persist in the Church for too long,” Vasa said.

The diocese, which serves about 160,000 Catholics from Petaluma to the Oregon border, has paid about $25 million to sex abuse victims since 1990….

LOS ANGELES (AP) — The Archdiocese of Los Angeles released 12,000 pages of personnel files on sexually abusive priests that Archbishop Jose Gomez described as “brutal and painful reading.” While many of the names of the abusers and accusations against them were known, the files reveal previously undisclosed details of how the church transferred priests out of state, sent them to therapists who wouldn’t report crimes and suppressed information from reaching the public. Lawyers for the archdiocese and priests who objected to the records being released did not return phone calls or an email seeking comment. Among the revelations in the trove of documents:

The church records show the archdiocese maneuvered behind the scenes to avoid a possible lawsuit against a priest over abuse allegations in Los Angeles. In 2007, five former altar boys from Tucson, Ariz., were awarded $1.5 million each as part of the archdiocese’s $660 million clergy-abuse settlement. The five said they were abused by the Rev. Kevin Barmasse, who was sent to Arizona during the 1980s after he’d been accused of child molestation in Los Angeles. The records show Monsignor Thomas Curry told Mahony in a Nov. 10, 1989, confidential memo that “the young boy involved is now about eighteen, so Kevin should certainly not return for another two years by which time the period for filing law suits will have passed.” Later that month, Mahony advised Barmasse to stay away from Los Angeles. “Your presence in this area … would greatly increase the possibility of a suit against you,” Mahony wrote. Barmasse was never criminally prosecuted.

February 2, 2013 OLYMPIA — The parents of a missing Utah mother pushed Friday for changes in Washington state laws on custody cases, saying proposed legislation might have prevented the killing of their two grandchildren.

Chuck and Judy Cox testified before a state Senate committee considering a bill that would restrict or block visitation rights for someone who is the subject of a murder investigation.

They told lawmakers the legislation could have changed the course of the case involving their missing daughter, Susan Powell, whose husband, Josh Powell, killed himself and their young kids during a parental visit last year….

Abuse victims ‘trafficked abroad’
Seventies paedophile ring in Barnes extended to Amsterdam, say two men who claim they were abused in brothels

Two alleged victims of a sophisticated paedophile ring at the centre of a police investigation claim they were taken on trips to Amsterdam where they were sexually abused in brothels in the 1980s.

One male victim had been taken from the Grafton Close care home in Richmond, south-west London, it is claimed, and, as well as being trafficked in Amsterdam, was rented out to customers at the Elm Guest House, a bed and breakfast nearby. Another man has claimed he was taken to Amsterdam on a different trip.

Police are understood to be looking into the men’s claims as part of Operation Fernbridge, an investigation into historic child abuse set up in the wake of the Jimmy Savile scandal. Detectives are building a picture of the reach of the network – which allegedly used the property – and have seized a number of files from local authorities.

The Elm Guest House in Rocks Lane, Barnes, said to have been frequented in the Seventies and Eighties by prominent peoples including former Tory politicians, is at the centre of the investigation….

Under the authority of that Tribunal as well as Common Law and the Natural Land Law Jurisdiction of Sovereign Nations, I declare that as of this day, Saturday, September 15, 2012, a Public International Court of Justice is hereby convened to consider evidence related to charges of crimes against humanity and criminal conspiracy by institutions of church and state, and their fiduciary officers.

The crimes that will be documented and judged in our Court are abominable and almost unimaginable. They span centuries, and range from outright murder to systematic torture, rape, slave labor, germ warfare, medical experimentation, drug testing, involuntary sterilizations, child trafficking, genocide and wars of extermination against peaceful nations. These crimes are all the more heinous by the fact that they were often aimed at children and occurred not randomly by isolated individuals, but historically, systematically, deliberately, and officially, by express command of heads of church and state according to their laws and customs – and by the fact that many of these crimes carry on today against the innocent at the hands of the same authorizing institutions and heads of state.

The enormity of these crimes requires a new approach. For this Court is a unique experiment, in that under existing international law, institutions cannot be brought to trial or account for genocidal or criminal actions, despite the fact that these crimes arise from and are caused by such institutions. There has consequently been no legal recourse for millions of people whose cultures and lives have been destroyed by the deliberate plans and actions of institutions of church and state, such as in the case of the conquest of entire continents of non-Christian people by European kingdoms operating under the sanction of so-called papal laws.

In October, the Survivors Network of those Abused by Priests (SNAP), the oldest, largest, and most visible peer counseling group for victims of clergy sex abuse in any denomination, received a subpoena from a Kansas City, Missouri, priest being prosecuted for sexually abusing an older male victim SNAP has never met. The subpoena demanded a sweeping range of documents and correspondence concerning thousands of the estimated 100,000-plus people SNAP has counseled over two decades.

In December, the group received a second subpoena from the other side of the state, from the Archdiocese of St. Louis, facing its own charges concerning the alleged abuse of a 19-year-old woman. SNAP has fought the requests, citing Missouri laws protecting the privacy of rape survivors, and describing the records-request as a coordinated Church effort to bully sex abuse victims into silence and harass a longtime opponent into bankruptcy.

While the United States Conference of Catholic Bishops has denied that there is a national strategy for the Church to fight sex abuse cases more aggressively, even the Church’s staunchest defenders see the pattern. As William Donohue, the pugilistic president of the Catholic League for Religious and Civil Rights, told the New York Times this week, bishops are going after SNAP because “SNAP is a menace to the Catholic Church.”….

What they’re trying to do is to discredit, derail, bankrupt, and silence SNAP. And to scare anyone—police, prosecutors, victims, concerned Catholics—from contacting us and reporting crimes and exposing corruption.

What they have said in court filings is we’re trying to get to the truth of this case. But if you think about it, the easiest way to get to the truth of John Doe BP v. Fr. Michael Tierney and the Kansas City Diocese and Jane Doe v. Fr. Joseph D. Ross and the St. Louis Archdiocese is to depose the parties, the people involved, John Doe and Jane Doe. And they haven’t even tried. In both cases, they haven’t even sought the records. In essence they’re using these two court cases as a ruse and a weapon.

Italy police break up global online pedophile network

ROME – Italian police have broken up a pedophile network spanning at least 28 countries that used social media websites to swap pornographic images and videos of child abuse.

Ten people have been arrested in Italy, the United States, France and Portugal, and another 112 are being investigated on suspicion of child pornography, Italy’s computer crime police bureau NIT said in a statement….

Ernest Willis, New Hampshire Man, Found Guilty Of Raping 15-Year-Old Tina Anderson; Pastor Sent Teen Off To Colorado (UPDATE) 9/6/11

Ernest Willis, a 52-year-old New Hampshire man, was found guilty of raping and impregnating a 15-year-old girl from his church who was shipped to Colorado by church leaders to give birth to his baby. Willis faces up to 54 years in prison for the sexual assault, The Denver Post reports. Willis will be sentenced Tuesday in Merrimack Superior Court.

UPDATE:

The Associated Press reports that Ernest Willis was sentenced Tuesday to 15 to 30 years in prison for raping Tina Anderson twice in 1997. Judge Larry Smukler said that Willis “robbed the girl of her childhood.” But Willis was stoic and although he said he was “sorry and ashamed for this thoughtless act of sexual misconduct,” he never admitted to forcible rape or to a second rape. Willis’ lawyers said they are planning to appeal those convictions.

Tina Anderson, who was 15 at the time of the rape, knew Willis from babysitting his children and from attending the same fundamentalist Baptist church in Concord, N.H.. The church pastor made young Anderson apologize to the congregation when she discovered that she was pregnant, but she was not allowed to tell the church goers that the pregnancy occurred because she was raped. With the consent of Anderson’s mother, the pastor then shipped the teenager to the home of a Colorado couple that she didn’t know and arranged for her baby to be adopted, according to ABC News.

Ernest Willis, a New Hampshire man accused of raping and fathering a child with a 15-year-old girl from his church in 1997, was found guilty today of three counts of forcible rape and a count of felonious sexual assault.

Willis’ case drew national headlines because his victim, Tina Anderson, who gave an exclusive interview to “20/20” last month, said she was forced to confess her “sin” — the pregnancy — in front of their congregation at Trinity Baptist Church, an Independent Fundamental Baptist Church (IFB) in Concord, N.H. The church’s then-pastor, Chuck Phelps, helped arrange for Anderson to move thousands of miles away from home to live with an IFB family and give her child up for adoption….

In an April interview with “20/20,” Anderson said that after being sexually assaulted twice by Willis, she was forced to stand before her Baptist congregation and confess her “sin” — that she had become pregnant. She said she wasn’t allowed to tell the group that the pregnancy happened because she was raped by Willis, a man twice her age.
