Ten victims of former Subway pitchman Jared Fogle have received a total of $1m in restitution since he agreed to plead guilty to receiving child abuse images and sex-crime charges, and his four other victims could receive their checks by the time he is sentenced next month – a move prosecutors said is rare.

The $100,000 checks were hand-delivered to each of the 10 victims or their parents over the last several weeks, with each signing a form saying they had received the money and that it is intended to benefit that particular victim, assistant US attorney Steven DeBrota told the Associated Press on Thursday….

By the time a federal judge sentences Fogle on 19 November to a minimum of five years in prison, DeBrota said prosecutors expect to have either presented checks to Fogle’s four other victims or have plans in place to disburse those funds to them.

That money will pay for mental health counseling, medical care and other needs the 14 victims might have now or in the future to help them recover from the trauma. Three adults and seven minors had received their checks as of Thursday. DeBrota said that money will help them “go on with their lives and put them where they should have been had none of this happened”….

Attorney Jeff Anderson asked jurors in Ramsey County Wednesday to award $11.7 million to a man who says he was sexually abused by a priest in the Diocese of Duluth when he was a teenager in the late 1970s.

The case is the first clergy sex abuse lawsuit to be argued in front of a jury in Minnesota since state lawmakers passed the Child Victims Act in 2013, according to available court records. The law opened a three-year window for people to file lawsuits for older incidents of abuse.

For decades, most clergy sex abuse cases in Minnesota had been settled privately or were tossed out of court. Earlier this year, the Archdiocese of St. Paul and Minneapolis prevented hundreds of cases from going to trial when it filed for bankruptcy….

Anderson told jurors that his 52-year-old client, identified in the lawsuit as Doe 30, had been sexually abused by the Rev. James Vincent Fitzgerald at St. Catherine’s parish in Squaw Lake, Minn., in about 1978. As a result of the abuse, Anderson said, the man has been unable to trust people, struggled in school, and has never been in a serious relationship….

….More than fifteen years in the making, The Witch-Hunt Narrative examines dozens of child sexual abuse cases from the 1980s. Over time, these cases ensnared dozens of defendants, some of whom were eventually cleared of any wrongdoing. Many experts believed these prosecutions came about when interrogators asked young children leading questions, resulting in a witch-hunt in which wrongful accusations were made against thousands of people.

Thanks in part to the work of Brown students, Cheit reviewed all the so-called witch-hunt cases and concluded that most of the charges brought against child molesters were grounded in some truth. At the very least, he says, there was enough credible evidence to begin police investigations.

Cheit, who holds a law degree and is also a professor of public policy, believes we are far too quick to dismiss the accounts of young children. “We have, over the last twenty years,” he writes in The Witch-Hunt Narrative, “discounted the word of children who might testify against sexual abuse. We have become more worried about overreacting to child sexual abuse than we are about underreacting to it.”….

‘At bedtime, his ritual began,’ he says in a 30-second preview clip for the show. Ahead of the show’s airing, OWN explained that Matthew would be sharing ‘a deeply personal account of the grooming, methodical control and manipulation he faced as a child’….

Sandusky, who retired in June 30, 1999 as Penn State’s defensive coordinator,  was convicted in 2012 of molesting 10 boys over 15 years, some in the football  team’s showers on campus. The 70-year-old is now serving a 30- to 60-year state prison sentence….

The interview comes two weeks after Pennsylvania’s attorney general released a review of the prosecution but found no evidence of political interference by  then Governor Tom Corbett.

The report, however, did reveal three years of ‘inexplicable delays’ to
prosecute the former Penn State football coach on child abuse charges.
The pedophile’s home was not searched and the report notes that it took a full year, from March 2009 until March 2010, for the office to recommend charging Sandusky when ‘Victim 1’ came forward….

In the early 1990s, a new narrative emerged that child sex abuse cases were part of a “moral panic” that produced a witch hunt, and the children who testified were not reliable and easily swayed by prosecutors. But Ross Cheit reveals that the issue had not been blown out of proportion at all. His book The Witch Hunt Narrative, shows that child sex abuse convictions were regular occurrences and that the crime occurred far more frequently than many believed.

Ex-senior judge Butler-Sloss to head child sex abuse inquiry 8 July 2014

Retired senior judge Elizabeth Butler-Sloss has been named as the chairwoman of a wide-ranging review into historical child sex abuse. The inquiry will examine how state institutions handled their duty of care to protect children from paedophiles…..

It comes after Mark Sedwill, the Home Office’s top civil servant, answered MPs’ questions about historical child abuse allegations. He was asked by the Commons Home Affairs Select Committee how his department lost or destroyed 114 files that could have shed light on alleged abuse. Mark Sedwill: “I am concerned about all material that we can’t find” Mr Sedwill told the committee the files, which relate to the 1980s and 1990s, were discovered missing after an expert investigator was drafted in to look into the Home Office’s handling of paedophile allegations in February last year.

He said the investigator discovered they were missing after he trawled a database of 750,000 files using search terms including “child abuse”, “paedophilia” and “PIE”, an anagram for the Paedophile Information Exchange….

Lady Butler-Sloss’s broader, independent inquiry, will look at how seriously public bodies and other important institutions have taken their duty of care to protect children from sexual abuse.

Police announce wider investigation into Knowl View ‘cover-up’  7 July 2014

Police have said there will be a wider investigation into an alleged cover-up  of sexual abuse claims at a school linked to the late MP Cyril Smith. Greater Manchester Police (GMP) has been looking at claims of abuse at Knowl View residential school for boys in Rochdale from the 1970s….

The Crown Prosecution Service has also released letters detailing why Cyril Smith was not prosecuted in 1998 and 1999, however much of the detail was released in 2012. On both occasions the files were passed to prosecutors but no charges were brought. Seven men have alleged they were abused by the former Rochdale MP at a residential school in Greater Manchester, police have said. Greater Manchester Police has said the men claimed they were abused by Smith at Knowl View in Rochdale in the 1970s and 1980s. In new book, Brown University professor aims to discredit ‘witch-hunt narrative’ of child sexual-abuse cases

PROVIDENCE — For decades, a view has persisted that a series of child sexual-abuse cases connected with child-care centers during the 1980s were witch hunts, fueled by social hysteria, that ended in wrongful convictions of many innocent people.
A new book by Brown University professor Ross E. Cheit, “The Witch-Hunt Narrative: Politics, Psychology, and the Sexual Abuse of Children,” explores the cases at the heart of that belief.
After 15 years of research into the history of child sexual-abuse cases, the political science and public policy professor seeks to discredit the “witch-hunt narrative.”
In an interview with The Providence Journal, Cheit said that those who believe this theory ignore even credible charges of child abuse and dismiss medical evidence that children were abused.
“I want to provoke discussion,” he said.
Much of the reason the witch-hunt narrative has prevailed, according to Cheit, is that it’s easier for people to believe that child sexual abuse doesn’t happen because the topic itself is taboo. Cheit cites the work of Dr. Suzanne M. Sgroi, who wrote in 1978 that “the sexual abuse of children is a crime that our society abhors in the abstract but tolerates in reality.”
Communities have been known to rally around people convicted of this crime, Cheit writes.
“We often minimize and deny so as to allow us to avoid seeing things we would rather not see. Turning a blind eye to the sexual abuse of children has a long history in this country.”
According to Cheit, the witch-hunt narrative often includes a “hero,” a journalist perhaps, who helps an innocent person escape a false conviction.
Unlearned Lessons of the McMartin Preschool case
It was the longest criminal trial in American history and it ended without a single conviction. Five people were charged with child sexual abuse based on extremely flimsy evidence. Some parents came to believe outlandish stories about ritual abuse and tunnels underneath the preschool. It is no wonder that the McMartin case, once labeled the largest “mass molestation” case in history, has come to be called a witch-hunt. In a commentary to a Retro Report earlier this month, Clyde Haberman, former Times reporter, repeated the view that the  case was a witch-hunt that spawned a wave of other cases of “dubious provenance.”
But does that description do justice to the facts?
A careful examination of court records reveals that the witch-hunt narrative about the McMartin case is a powerful but not entirely accurate story. For starters, critics have obscured the facts surrounding the origins of the case….recently asserted that the McMartin case began when Judy Johnson “went to the police” to allege that her child had been molested.
….But the Manhattan Beach Police did not begin this case on the word of Judy Johnson. Instead, they were moved by the medical evidence of anal trauma on her son. Johnson did not come to the police station on August 12; she went to her family doctor who, after examining her son, referred him to an Emergency Room. That doctor recommended that the boy be examined by a specialist. The pediatric specialist is the one who reported to the Manhattan Beach Police Department that “the victim’s anus was forcibly entered several days ago.”
Although Judy Johnson died of alcohol poisoning in 1986, making her an easy target for those promoting the witch-hunt narrative, there is no evidence that she was “psychotic” three years earlier. A profile in the now-defunct Los Angeles Herald-Examiner, published after Johnson died, made it clear that she was “strong and healthy” in 1983 and that she “jogged constantly and ate health food.” ….
The witch-hunt narrative has replaced any complicated truths about the McMartin case….It wasn’t all a witch-hunt….

What is your book about? The witch-hunt narrative claims that there was a series of child sexual abuse cases in the 1980s and 1990s that were hoaxes and that children are highly suggestible when questioned about possible sexual abuse. The idea that children are highly suggestible is still with us, and the people who believe that use these cases as the evidence….

In the book you reference your own experience with sexual abuse at a camp for the San Francisco Boys’ Chorus. How do you avoid bias? The way I’ve designed my research, it forces me to confront the best arguments that support the witch-hunt narrative.  The McMartin Preschool case….I knew that case was going to be the most flawed. After spending weeks reviewing the original transcript of the case, I concluded that there were plenty of reasons for jurors to conclude that the original defendant, Ray Buckey, was guilty. The rest of the case was deeply flawed, and I lay that out in my book. The book is documented to the max. I don’t make any claims that aren’t documented….

What are the policy implications of the book? What’s most worrisome to me is that the witch-hunt narrative unfairly impugns children. The ongoing challenge in this field is, if you ask children a series of open-ended questions about the alleged abuse and don’t get anywhere, then what do you do? I think there are people who are too worried about being criticized for asking leading questions or interviewing a child a second time.

What that leads to are abused kids who don’t disclose. I’ve seen almost no concern or acknowledgement of that issue in the psychology literature, but a lot of people are worried about false convictions. There is also a claim that there are economic motives to find abuse and that federal programs create the incentive to find abuse. I think this is completely wrong-headed. I worry that there are political forces that want to weaken the Child Abuse Prevention and Training Act, get rid of mandatory reporting, and undermine the credibility of front-line professionals, from pediatricians to forensic interviewers, who serve and protect children….

Child sexual abuse cases in Hollywood attract attention

At least a dozen child molestation and child pornography prosecutions since 2000 have involved actors, managers, production assistants and others in the entertainment industry.

….Advocates and professionals who work with victims of child sexual abuse say predators exploit the glittery lure of Hollywood to prey on aspiring actors or models. They assert that the problem is more widespread than the industry is willing to acknowledge and have called for tougher laws and better screening of those who represent or work with children.

“Unlike other settings, such as Little League, Scouts, day care and school volunteers, where adults who have unsupervised access to children are required to comply with fingerprinting requirements, there are no such standards in the entertainment industry,” said Paula Dorn, co-founder of the BizParentz Foundation, a nonprofit group for families of child actors.

….The recent arrests prompted a bill, expected to be filed this month with the California Assembly, that would require licensing and criminal background checks for those who work with actors under age 16. It would prohibit registered sex offenders from serving as child managers, photographers, career counselors or publicists.

“Under the existing law, talent agents are regulated; however, casting directors, managers and photographers are not. This loophole makes it very easy for a predator to gain access to children working within the entertainment industry,” said the bill’s sponsor, Assemblywoman Nora Campos (D-San Jose).
