Bill Cosby seeks court sanctions against accuser over deposition leak

Comedian Bill Cosby filed legal papers on Tuesday calling for court sanctions against a woman accusing him of sexual assault, saying she breached their confidentiality agreement in the leak of his full deposition from a 10-year-old civil case to the New York Times.

Cosby, 78, made the filing in U.S. District Court in Philadelphia in opposition to recent motions by Andrea Constand, a former Temple University employee who has alleged the comedian tricked her into taking drugs before he sexually assaulted her.

The lawsuit she brought against Cosby was settled for an undisclosed sum in 2006, and all documents from the litigation were sealed until a federal judge on July 6 released limited redacted excerpts from Cosby’s 2005 deposition testimony in the case.

Those excerpts included Cosby’s admission under oath that he had obtained Quaaludes, the brand name for a sedative widely abused as a recreational drug in the 1970s, with the intent of giving the pills to young women in order to have sex with them.

On July 8, Constand filed papers in court seeking to unseal the entire deposition and her settlement agreement with Cosby, as well as to free her from any confidentiality restrictions.

The New York Times has since obtained its own record of Cosby’s deposition and posted additional excerpts on its website, revealing testimony in which the entertainer described how he had pursued women and how he obtained Quaaludes.

Cosby’s own court filing on Tuesday stressed that the deposition excerpts so far unsealed by the judge contain no testimony that he engaged in any non-consensual sex or gave anyone Quaaludes without their knowledge or consent….

THE former Tory Home Secretary’s name is on government file along with other powerful Westminster officials from the 1970s and 80s including Sir Peter Morrison.

LEADING Westminster figures from the 1970s and 80s including the late Leon Brittan have been named in Government child abuse documents, it was reported last night.

Sky News said that after months of requests Whitehall has finally revealed that papers do exist relating to Margaret Thatcher’s former parliamentary secretary the late Sir Peter Morrison, former Home Secretary Sir Leon, former diplomat the late Sir Peter Hayman and former minister the late Sir William van Straubenzee.

It came after the Government released the details in January of a file prepared for Mrs Thatcher’s office on the ‘unnatural sexual’ behaviour of one of the men Sir Peter Hayman.

The new batch of file names reveal there were further Government papers relating to the former MI6 man and career diplomat.

The content of the papers have not been revealed, however.

Sky News said the documents have been shared with the police and will be passed to the Child Abuse Inquiry led by Justice Lowell Goddard….

Karen Morgan said the church offered no help when she reported the abuse

From when Karen Morgan was 12, until she was well into her teens, she was sexually abused by her uncle – a ministerial servant with the Jehovah’s Witnesses….

But what is striking about the Jehovah’s Witnesses is their explicit policy of dealing with abuse in-house.

Because of their practice of following the Bible literally, they insist there must be two witnesses to a crime, often not the case in child abuse cases.

However, in Karen’s case a second witness did come forward: Wendy, a family friend and fellow member of the Barry congregation in south Wales. She had been raped by the same man.

When she reported the crime to elders, Wendy was made to describe it in minute detail to a group of older men.

Later, she had to give her account again in the same room as Sewell….

Afterwards, the elders told her that as it was only her account against that of Sewell, nothing more could be done.

This bringing together of the accused and the accuser in a “judicial committee” is a common feature of Jehovah’s Witnesses’ justice.

Karen, still a teenager at the time, was put through the process.
Reluctance to co-operate

The elders also ruled that their separate accusations didn’t constitute the required two witnesses.

Despite a pattern of predatory sexual behaviour, it took more than two decades to bring Wendy and Karen’s abuser to justice.

He is now serving a 14-year prison sentence.

His punishment from the Jehovah’s Witnesses? There wasn’t one.

Even when the case came to court, the organisation was reluctant to co-operate….

In a programme for Radio 4’s The Report, we have identified this lack of co-operation in several other similar cases.

Confidential documents from the Watchtower Bible and Tract Society of Britain – the official name for the Jehovah’s Witnesses – that we have seen are explicit about the best way to deal with such matters being within the congregation….

UN official who failed to act on child sex abuse allegations resigns

UNITED NATIONS –  The U.N. rights official who admitted not following up for months on allegations of child sexual abuse by French soldiers in Central African Republic has resigned.

The U.N. confirmed Wednesday that Flavia Pansieri has left the post of deputy high commissioner for human rights “for health reasons.” No more details were given.

The allegations by several children as young as 9 of trading oral sex and sodomy for food with French soldiers tasked with protecting civilians in the violence-torn country didn’t become public until late April, almost a year after U.N. staffers first heard the children’s stories. Pansieri’s comments and other leaked documents led the U.N. secretary-general this summer to order an investigation into how the U.N. handled the case.

In a confidential statement for a separate internal investigation, obtained by The Associated Press, Pansieri said she had been distracted from the case by other issues, including budget cuts for several months. “I regret to say that in the context of those very hectic days, I failed to follow up on the CAR situation,” Pansieri said in the statement dated March 26.

She said she and her boss, high commissioner Zeid Raad al-Hussein, had assumed French authorities were handling the allegations, even as France pressed the U.N. for months for more information….

The UN secretary general, Ban Ki-moon, has made a dramatic intervention in the scandal of French peacekeepers allegedly abusing children in Africa by announcing an independent external review of how his organisation handled the affair.

The move is the first public intervention by the secretary general into what has become a growing controversy for the UN. Pressure is growing on the organisation and on the French authorities to explain when and how they reacted to revelations by children in Central African Republic last year that they were being sexually exploited by French soldiers at a camp for internally displaced people.

In April the Guardian revealed that a senior UN official, Anders Kompass, had been suspended for disclosing an internal report on the alleged abuse to French prosecutors. Documents released last week, including a statement from Kompass, stated his position that he had passed the report to the French because he was concerned the UN would do nothing to stop the abuse. He has been reinstated but is still under internal investigation and could be dismissed….

French prosecutors have ordered a criminal investigation into allegations that French peacekeeping soldiers raped children and demanded sex for food in the Central African Republic.

The decision follows revelations in the Guardian more than a week ago that a senior United Nations official had been suspended for leaking details of the alleged abuse to the French government.

The Paris prosecutor’s office said on Thursday it had decided to launch criminal proceedings after receiving a reply to its request for information from the UN about the accusations of sexual abuse by French soldiers serving with the peacekeeping operation Sangaris.

It said the investigation concerned “the rape of minors under 15 years old by persons who had abused the authority conferred upon them by their roles, and complicity in this crime”….

Kompass, director of field operations, was suspended last month and faces an internal disciplinary disciplinary hearing for breaching UN protocols.

On Wednesday an appeal tribunal found that the suspension of Kompass was unlawful and ordered his reinstatement while an internal management review continues….

An appeal tribunal has ordered the United Nations to immediately lift the suspension of a whistleblower who disclosed the alleged sexual abuse of children by peacekeeping troops in Africa to the French authorities.

A judge said on Wednesday the decision to suspend Anders Kompass, the director of field operations for the Office of the High Commissioner for Human Rights, was “prima facie unlawful”. He ordered his employers in the UN to lift his suspension immediately to prevent further damage to his reputation.

The decision is a blow to senior UN officials who have repeatedly defended their treatment of Kompass, claiming he breached strict protocols about the passing on of confidential information to outside authorities….

South Yorkshire Police warned twice of Rotherham child abuse but did not act, as commissioner claims girls were seen as ‘willing’

Senior members of South Yorkshire police were warned twice of the serious child abuse being carried out in Rotherham around a decade before it was discovered 1,400 children had been raped, trafficked and groomed over a period of 16 years – but no action was taken at the time.

The Sheffield Star has obtained reports from 2003 and 2006 detailing the organised child sexual exploitation being carried out in Rotherham and Sheffield.

Dr Angie Heal, the author of the reports, stated at the time it was “very evident” that “significant abuse” was taking place in Sheffield and Rotherham, in 2003, and in 2006 found that that the perpetrators of sexual abuse had been able to “carry on with impunity”.

The reports were sent to both South Yorkshire Police district commanders, chief superintendents and CID and community safety superintendents at the time, but no action was taken. The newspaper obtained the documents through a Freedom of Information request.

As the news of the warnings emerge, South Yorkshire’s current police and crime commissioner has claimed that  “it all went wrong” in Rotherham because police had not understood what grooming was, nor recognised the abuse, and had instead seen the girls as prostitutes….

France investigates claims of CAR child abuse by soldiers 4/29/15
A Parisian prosecutor says an investigation is under way into claims French soldiers in the Central African Republic sexually abused children.

France sent an initial 1,600 troops to the country in December 2013 after violence flared following a coup.

On Wednesday, the Guardian newspaper reported that a United Nations worker was suspended after leaking a report on abuses by French troops.

It says a UN report claimed children as young as nine were abused.

Agnes Thibault-Lecuivre, a spokeswoman for the Paris prosecutor’s office, said an investigation had been under way since July 2014.

The Guardian said that the alleged abuse took place between December 2013 and June 2014 at a centre for internally displaced people in the Central African Republic capital, Bangui.

Quoting an internal UN report, it says that in one case, a nine-year-old boy and his friend were forced to carry out a sex act by two French soldiers….

A senior United Nations aid worker has been suspended for disclosing to prosecutors an internal report on the sexual abuse of children by French peacekeeping troops in the Central African Republic.

Sources close to the case said Anders Kompass passed the document to the French authorities because of the UN’s failure to take action to stop the abuse. The report documented the sexual exploitation of children as young as nine by French troops stationed in the country as part of international peacekeeping efforts.

Kompass, who is based in Geneva, was suspended from his post as director of field operations last week and accused of leaking a confidential UN report and breaching protocols. He is under investigation by the UN office for internal oversight service (OIOS) amid warnings from a senior official that access to his case must be “severely restricted”. He faces dismissal….

Entitled Sexual Abuse on Children by International Armed Forces and stamped “confidential” on every page, the report details the rape and sodomy of starving and homeless young boys by French peacekeeping troops who were supposed to be protecting them at a centre for internally displaced people in Bangui, capital of the Central African Republic.

Donovan said: “The regular sex abuse by peacekeeping personnel uncovered here and the United Nations’ appalling disregard for victims are stomach-turning, but the awful truth is that this isn’t uncommon. The UN’s instinctive response to sexual violence in its ranks – ignore, deny, cover up, dissemble – must be subjected to a truly independent commission of inquiry with total access, top to bottom, and full subpoena power.”

The UN has faced several scandals in the past relating to its failure to act over paedophile rings operating in the Democratic Republic of Congo, Kosovo and Bosnia. It has also faced allegations of sexual misconduct by its troops in Haiti, Burundi and Liberia….

The children described how they were sexually exploited in return for food and money. One 11-year-old boy said he was abused when he went out looking for food. A nine-year-old described being sexually abused with his friend by two French soldiers at the IDP camp when they went to a checkpoint to look for something to eat.

The child described how the soldiers forced him and his friend to carry out a sex act. The report describes how distressed the child was when disclosing the abuse and how he fled the camp in terror after the assault. Some of the children were able to give good descriptions of the soldiers involved.

In summer 2014, the report was passed to officials within the office of the high commissioner for human rights in Geneva. When nothing happened, Kompass sent the report to the French authorities and they visited Bangui and began an investigation….

A high court judge is to investigate whether child sexual abuse allegations against Lord Janner were the subject of an establishment cover-up.

Justice Lowell Goddard, the chair of a major independent inquiry into child abuse ordered by the home secretary, Theresa May, will seek evidence from the Labour peer’s alleged victims and may even summon the 86-year-old to give evidence.

The New Zealand judge has also asked Britain’s top prosecutor, Alison Saunders, to hand over all the prosecution files against Janner as part of an “exhaustive and critical examination of the institutional decision-making processes” in the case. She said she would scrutinise three missed opportunities to prosecute Janner by the police or the CPS in 1991, 2002 and 2007 and “whether any inappropriate influence was brought to bear in any effort to shield Lord Janner from prosecution”.

The announcement came after Saunders, the director of public prosecutions, attracted widespread criticism earlier this month when she said there was sufficient evidence to prosecute Janner over 22 alleged sexual offences but that he would not be prosecuted because he has Alzheimer’s disease….

Janner, who has dementia, was accused of carrying out a catalogue of abuse against young boys, and more than a dozen people came forward to claim he abused them during the 1960s, 1970s and 1980s….

NEW YORK (AP) — A second U.N. committee plans to question Vatican officials on failures to stop clergy sex abuse.

The hearing scheduled for May 5-6 in Geneva will look at whether the Vatican’s record on child protection violates the U.N. Convention Against Torture. The Holy See ratified the treaty in 2002….

Last January, Vatican officials testified for eight hours before an obscure human rights committee on the scale of clergy sex abuse globally.

The Vatican was compelled to appear as a signatory to the U.N. Convention for the Rights of the Child, which requires governments to take all adequate measures to protect children from harm. The Holy See was one of the first states to ratify the treaty in 1990.

The U.N. committee issued a scathing report, accusing Vatican officials of systematically placing their own interests over those of victims. The Vatican condemned the findings as a reflection of “prejudiced” positions of anti-Catholic advocacy groups.

The United Nations has demanded the Vatican “immediately remove” all clergy who are known or suspected child abusers and turn them over to authorities.
 
In an unprecedented report the UN Committee on the Rights of the Child said the Holy See should also hand over its archives on the sexual abuse of tens of thousands of children so culprits, as well as “those who concealed their crimes”, could be held accountable.
 
The watchdog’s exceptionally blunt paper – the most far-reaching critique of the Catholic Church hierarchy by the world body – followed its public grilling of Vatican officials last month.
 
“The committee is gravely concerned that the Holy See has not acknowledged the extent of the crimes committed, has not taken the necessary measures to address cases of child sexual abuse and to protect children, and has adopted policies and practices which have led to the continuation of the abuse by and the impunity of the perpetrators,” the report said….
 
Abusers had been moved from parish to parish or other countries “in an attempt to cover-up such crimes,” it added.
 
“Due to a code of silence imposed on all members of the clergy under penalty of excommunication, cases of child sexual abuse have hardly ever been reported to the law enforcement authorities in the countries where such crimes occurred,” the UN body said….

The Vatican faced blistering criticism from a United Nations committee Thursday over allegations it protected pedophile priests at the expense of victims in what constituted a worldwide sex abuse scandal.

It was the first time representatives of the Holy See were questioned in public on cases of sexual abuse by Catholic clergy around the world.

The U.N. committee’s main human rights investigator, Sara Oviedo, led the most intense grilling the Holy See has received on the issue, according to a report by The Associated Press.

Given the “zero tolerance” policy of the Vatican, she asked, why were there “efforts to cover up and obscure these types of cases?”….

They include fee-paying institutions Caldicott, in Farnham, Bucks, where Deputy PM Nick Clegg went and Ashdown House, East Sussex, London Mayor Boris Johnson’s prep school.

The allegations span from the 1950s to the 1990s.

Jessica Standley, of lawyers Slater & Gordon, said since Savile there had been “an increase in victims reporting abuse at institutions”….

‘Savile scandal made mum tell cops about Roache rape’ Alleged victim’s son speaks out

THE son of a woman accusing Bill Roache of rape has said she wouldn’t report him as she “didn’t want to cause a rift in his family”.

The man, who was not identified, added that he only became of his mum’s experience after the Jimmy Savile scandal.

Giving evidence, the alleged rape victim’s son said he recalled a conversation with her about the time the Jimmy Savile and Cyril Smith cases emerged in 2012….

The man told his mum that she should go to the police as there may be more women out there and that “sometimes it takes that one person to have the strength to come forward”.

“She really didn’t want to. She was telling me straight away that some things are just best left alone in the past.

“She didn’t want to cause a rift between his family and on top of that she desperately didn’t want anyone to find about it.”

He said that remained the case and some members of her family still don’t know.

Roache, 81, of Wilmslow, Cheshire, denies the rapes and five counts of indecent assault involving the four other complainants aged 16 and under on dates between 1965 and 1971….

Freddie Starr has been arrested for a third time by police investigating the Jimmy Savile sex abuse scandal.

The comedian, 71, was told that he faces a further allegation of sexual offences when he attended a police station in Warwickshire by appointment.

Starr was first arrested more than a year ago by detectives from the Metropolitan Police’s Operation Yewtree, the investigation launched in the wake of claims against Savile….
