PHILADELPHIA (Reuters) – The prosecution rested its case on Thursday against Philadelphia Archdiocese Monsignor William Lynn, the most senior U.S. clergyman to go to trial in the Roman Catholic Church’s pedophilia scandal.

During nearly eight weeks of startling testimony about the lurid lives of predatory priests, Lynn, a former secretary of the clergy, has sat stoically in his clerical garb as the case unfolded in an often-packed courtroom.

Lynn, 61, is charged with child endangerment and conspiracy over accusations he covered up child sex abuse allegations against priests, many of whom were simply transferred to unsuspecting parishes.

He faces the possibility of 28 years in prison if convicted.

The trial that started on March 26 has drawn a spotlight on the Philadelphia Archdiocese, the nation’s sixth largest with 1.5 million members, in a case experts say is likely being watched by the Vatican.

Defense lawyers promised to begin their case on Tuesday to bolster Lynn’s argument that he acted responsibly, reporting allegations to higher officials, but was overruled.

Lynn served in essence as the personnel director of the archdiocese under the late Cardinal Anthony Bevilacqua, the long-time archbishop of Philadelphia….

A grand jury that indicted Lynn and four others said in its January 2011 report that “Over the past two decades, Msgr. Lynn has put literally thousands of children at risk of sexual abuse by placing them in the care of known child molesters.”

The Catholic Archbishop of Dublin, Dr Diarmuid Martin, has called for an independent international commission of inquiry into the crimes of Fr Brendan Smyth, the late paedophile priest.

Dr Martin said such an inquiry was owed to victims and that it would be in the public interest that the full story, and not bits and pieces, should come out….

An American lawyer who was abused by Fr Brendan Smyth has said that the Vatican has “blood on its hands” for its failure to inform Irish Church authorities that it had censured Smyth for abuse in the United States years before the 1975 secret inquiry.

Helen McGonigle has learnt that the Vatican’s Congregation for the Religious issued a decree that Smyth wasn’t allowed to take Confession and was to be supervised following abuse complaints made in the late 60s.

Yet, in 1975 the Bishop of Kilmore and the Abbot of Killnacrott agreed a similar censure of Smyth — seemingly oblivious that a similar reprimand had already been handed down.

“Why didn’t the bishop or the abbot inform the Papal Nuncio of this second censure? Why weren’t they informed by the Vatican of the original censure? It is very clear that the 1968 censure was not enforced. What does all of this say about the organisation that is the Catholic Church,” Ms McGonigle asked.

Ms McGonigle has pleaded with police on both sides of the border to investigate Cardinal Brady for his possible role in perverting the course of justice and endangering children.

She pointed to current cases being taken against Catholic priests in the US for failing to report abuse allegations to the civil authorities.

“They are enablers, Cardinal Brady and all these priests. That is what they were asked to do and that’s what they have done,” she said.

Report says Cardinal Brady likely to be gone to retirement by end of year

The Vatican is expected to replace Ireland’s leading church figure. Cardinal Sean Brady, and will appoint a coadjutor or deputy bishop by the end of this year who will eventually be his replacement.

The Irish Times has reported that the Vatican move will happen because of  massive public pressure on Brady over his actions concerning the notorious pedophile priest Fr. Brendan Smyth.

Brady is primate of all Ireland, essentially Ireland’s leading Catholic figure, based in Armagh.

The Vatican is expected to act after a BBC documentary alleged that Brady was far more involved in a cover up of Smyth than he admitted at the time in 1987. Brady, then a young priest, served on a panel investigating Smyth. No action was taken against Smyth and  he went on to abuse many more kids.

The Vatican at first defended Brady and said he had their full confidence. However, Irish leader Enda Kenny, Deputy leader Eamon Gilmore, and Northern Irish leader Martin McGuinness, have all called on Brady to resign….

Brady, 73, managed to keep his position after an earlier controversy about Smith and how he handled the case. This latest crisis, however, is seen as far more serious.

If Brady is forced to step down, it will be the 2nd major figure that Fr. Brendan Smyth has been instrumental in forcing out of office.

Former Irish leader Albert Reynolds also resigned after becoming involved in the Smyth controversy….

Advisers backed resignation of Cardinal Sean Brady to save Catholic Church’s image

Cardinal Sean Brady was backed by his senior advisers when he offered to resign more than two years ago.

The head of the Catholic Church in Ireland informed the Vatican of his “willingness to stand aside” as one of a range of possible options when his role in the Brendan Smyth controversy became public in 2010.

And his senior advisers backed the move — expressing concern that the Smyth controversy would damage the church.

The cardinal is now planning an alternative exit strategy.

Cardinal Brady had asked the Pope for ‘Episcopal help’ or an auxiliary bishop two years ago when the controversy first erupted, but the bishop was not appointed.

However, the church confirmed yesterday that the request has been “reactivated”.

Pressure is growing on the PSNI to interview Cardinal Sean Brady over the most recent claims in the child sex abuse scandal.

The police didn’t act two years ago when the revelations that Dr Brady was present at the interview of two victims of paedophile priest Brendan Smyth first emerged.

One of the young victims, Brendan Boland, gave the names and addresses of several other children he knew were being abused by Smyth.

Despite this evidence nothing was done to warn the children’s parents or inform the police, and Smyth went on to abuse dozens more children over subsequent decades until he was finally brought to justice in the 1990s, dying in prison in 1997.

He had been abusing children since the 1940s.

ERFURT, Germany — Pope Benedict XVI met with German victims of sexual abuse by priests and expressed “deep compassion and regret” at the suffering of those abused by members of the clergy, the Vatican said Friday….

Germany’s Catholic church has seen the numbers of faithful leaving the congregation jump, after hundreds of people came forward last year with stories of having been physically or sexually abused by members of the clergy. Church leaders had expressed hope that Benedict’s visit could help heal wounds left by the scandal.

Benedict has been accused by victims groups and their lawyers of being part of systematic practice of cover-up by church hierarchy for pedophile priests, in his earlier roles as an archbishop in Germany and later at the helm of the Vatican morals office….

September 13, 2011 – A survivor-led support group for clergy sex abuse victims today formally urged the International Criminal Court (ICC) prosecutor to investigate the Vatican for crimes against humanity. Leaders of SNAP, the Survivors Network of those Abused by Priests, together with their attorneys from the human rights organization the Center for Constitutional Rights (CCR), filed a lengthy and detailed complaint charging that Vatican officials tolerate and enable the systematic and widespread concealing of rape and child sex crimes throughout the world. Together with the complaint, they submitted more than 20,000 pages of supporting materials consisting of reports, policy papers, and evidence of the crimes by Catholic clergy committed against children and vulnerable adults.

SNAP members from Germany, Belgium, the Netherlands and the U.S. traveled to The Hague to insist that the ICC take action and prosecute the Pope and three other high-ranking Vatican officials for their direct and superior responsibility for the crimes against humanity of rape and other sexual violence committed around the world.

The Vatican has rejected claims by Irish PM Enda Kenny that it sabotaged efforts by Irish bishops to report child-molesting priests to police.

It follows the damning Cloyne Report that showed how allegations of clerical sex-abuse in Cork had been covered up.

In a speech to parliament in July, Mr Kenny accused the Church of putting its reputation ahead of abuse victims.

The Vatican said it was “sorry and ashamed” over the scandal but said his claims were “unfounded”….

“The Holy See… in no way hampered or sought to interfere in any inquiry into cases of child sex abuse in the Diocese of Cloyne.”

“Furthermore, at no stage did the Holy See seek to interfere with Irish civil law or impede the civil authority in the exercise of its duties.”

‘Misinterpretation’

Mr Kenny had told the Irish parliament that the report into how allegations of sex abuse by priests in Cork had been covered up showed change was urgently needed.

“The rape and torture of children were downplayed or ‘managed’ to uphold instead the primacy of the institution, its power, standing and ‘reputation’,” he said.

Parliament then passed a motion deploring the Holy See for “undermining child protection frameworks” after a letter to Irish bishops appeared to diminish Irish guidelines on reporting sex abuse by referring to them as “study guidelines”…..

Released in July, the 400-page Cloyne Report found that Bishop John Magee – who stood down in March 2009 after serving as bishop of Cloyne since 1987 – had falsely told the government and the health service that his diocese was reporting all abuse allegations to authorities.

It also found that the bishop deliberately misled another inquiry and his own advisors by creating two different accounts of a meeting with a priest suspected of abusing a child – one for the Vatican and the other for diocesan files.

It discovered that, contrary to repeated assertions on its part, the Diocese of Cloyne did not implement the procedures set out in the Church protocols for dealing with allegations of child sex-abuse. It said the greatest failure was that no complaints, except one in 1996, were reported to the health authorities until 2008….

An attorney for a man who claims he was sexually abused by an Oregon priest in the 1960s said yesterday that the Vatican failed to produce all court-ordered documents in the case, and that papers it did turn over show how the Vatican exercises firm control over the placement and removal of offending priests.

Both claims were quickly disputed by a church lawyer who said the Vatican gave Minnesota-based attorney Jeffrey Anderson all its documents pertaining to the late Rev. Andrew Ronan. Anderson has sued on behalf of a man who alleges Ronan abused him during the time the priest was assigned to Portland, Ore.

The Vatican gave Anderson more than 1,800 pages of documents last Friday, marking the first time the Vatican provided documents in response to a sex abuse lawsuit. But Anderson contends that relevant documents written by Vatican officials were left out because local dioceses have produced their own copies of such paperwork in this and other cases.

Anderson, who has filed numerous lawsuits nationwide on behalf of alleged victims of priest abuse, is trying to hold the Vatican responsible under US and Oregon law for the abuse alleged by a Washington state man identified only as John V. Doe. He argues that the Vatican was effectively Ronan’s employer when the alleged abuse occurred in the mid-1960s. Ronan died in 1992.

An employment relationship could trigger an exception to a federal law that usually bars lawsuits against foreign sovereign entities such as the Vatican.

Ireland’s prime minister has launched an unprecedented attack on the Vatican, accusing it of downplaying the rape and torture of Irish children by clerical sex abusers.

Enda Kenny said in parliament that the Cloyne report, released on 13 July, had exposed the Vatican’s attempt to frustrate the inquiry into child sex abuse.

During a debate on the fallout from the Cloyne findings, the taoiseach said the report had illuminated the dysfunction and elitism still dominant in the Vatican….

Kenny said the rape and torture of children had been downplayed or “managed” to uphold the institution’s power and reputation.

The all-party motion being debated in the Dáil “deplores the Vatican’s intervention which contributed to the undermining of child protection frameworks and guidelines of the Irish state and the Irish bishops”.

One of the most damning findings of the Cloyne report was that the diocese failed to report nine out of 15 complaints made against priests, which “very clearly should have been reported”.

….“Over and over, from the beginning of this, Sen. Fasano kept asking about the 31 days: why is it that this child was missing for 31 days and no one reported it?” said Greg Giordano, Fasano’s chief legislative aide.

“As we know now, there is no law in Florida that requires that missing children be reported to law enforcement within a certain time-frame.  If there had been such a law on the books this case may have turned out quite differently.”

Fasano hopes to close this loophole in Florida law, and I think it would get law enforcement involved in a timely fashion when there is a missing child. Also, it is another tool that could be used in a prosecutor’s arsenal whenever someone is eventually charged by the state for this type of crime….

“Senator Fasano is proposing legislation that will require a caretaker (someone in a custodial role, i.e. parent, grandparent, babysitter, guardian, etc) who willfully or by culpable negligence fails to make contact or verify the whereabouts of a child 12 years of age or younger for a period of 48 hours will be guilty of a third degree felony if he/she fails to report the child’s absence to law enforcement at the end of said 48 hours.

“If the child suffers great harm, disability or permanent disfigurement while missing the charge will be raised to a second degree felony.

In an unprecedented attack, the taoiseach said the historic relationship between church and state in Ireland could not be the same again and the report exposed the “elitism, dysfunction, disconnection, and narcissism that dominated the Vatican”.
