Church’s Lawyers Have SNAP in Their Sights – Victims’ advocacy group’s national director speaks to RD about a flurry of subpoenas, and fears of ongoing harassment

In October, the Survivors Network of those Abused by Priests (SNAP), the oldest, largest, and most visible peer counseling group for victims of clergy sex abuse in any denomination, received a subpoena from a Kansas City, Missouri, priest being prosecuted for sexually abusing an older male victim SNAP has never met. The subpoena demanded a sweeping range of documents and correspondence concerning thousands of the estimated 100,000-plus people SNAP has counseled over two decades.

In December, the group received a second subpoena from the other side of the state, from the Archdiocese of St. Louis, facing its own charges concerning the alleged abuse of a 19-year-old woman. SNAP has fought the requests, citing Missouri laws protecting the privacy of rape survivors, and describing the records-request as a coordinated Church effort to bully sex abuse victims into silence and harass a longtime opponent into bankruptcy.

While the United States Conference of Catholic Bishops has denied that there is a national strategy for the Church to fight sex abuse cases more aggressively, even the Church’s staunchest defenders see the pattern. As William Donohue, the pugilistic president of the Catholic League for Religious and Civil Rights, told the New York Times this week, bishops are going after SNAP because “SNAP is a menace to the Catholic Church.”….

Why do you think they are doing this?

What they’re trying to do is to discredit, derail, bankrupt, and silence SNAP. And to scare anyone—police, prosecutors, victims, concerned Catholics—from contacting us and reporting crimes and exposing corruption.

What they have said in court filings is we’re trying to get to the truth of this case. But if you think about it, the easiest way to get to the truth of John Doe BP v. Fr. Michael Tierney and the Kansas City Diocese and Jane Doe v. Fr. Joseph D. Ross and the St. Louis Archdiocese is to depose the parties, the people involved, John Doe and Jane Doe. And they haven’t even tried. In both cases, they haven’t even sought the records. In essence they’re using these two court cases as a ruse and a weapon.

Italy police break up global online pedophile network

ROME – Italian police have broken up a pedophile network spanning at least 28 countries that used social media websites to swap pornographic images and videos of child abuse.

Ten people have been arrested in Italy, the United States, France and Portugal, and another 112 are being investigated on suspicion of child pornography, Italy’s computer crime police bureau NIT said in a statement….

Cardinal Anthony J. Bevilacqua ordered aides to shred a 1994 memo that identified 35 Archdiocese of Philadelphia priests suspected of sexually abusing children, according to a new court filing.

The order, outlined in a handwritten note locked away for years at the archdiocese’s Center City offices, was disclosed Friday by lawyers for Msgr. William J. Lynn, the former church administrator facing trial next month.

They say the shredding directive proves what Lynn has long claimed: that a church conspiracy to conceal clergy sex abuse was orchestrated at levels far above him.

“It is beyond doubt that Msgr. Lynn was completely unaware of this act of obstruction,” attorneys Jeffrey Lindy and Thomas Bergstrom wrote.

Their motion asks Common Pleas Court Judge M. Teresa Sarmina to dismiss the conspiracy and endangerment charges against Lynn, or to bar prosecutors from introducing Bevilacqua’s videotaped testimony at trial….

The revelation is likely to further cloud Bevilacqua’s complicated legacy in the handling of clergy sex abuse and could shape what happens at the historic trial, the first for a cleric accused of covering up sex abuse….

Prosecutors say that Lynn, as the secretary for clergy, recommended priests for assignments despite knowing or suspecting that they would sexually abuse children. Facing trial with him are two former parish priests accused of molesting a boy in the 1990s, the Rev. James J. Brennan and Edward Avery.

In their motion, Lynn’s lawyers argue that the new documents show he was one of the few church officials trying to confront the issue of abuse.

After becoming secretary for clergy in 1992, they say, Lynn began combing the secret personnel files of hundreds of priests to gauge the scope of misconduct involving children. He did it, his lawyers said, because he “felt it was the right thing to do.”

SAN ANGELO, Texas (AP) — Polygamist sect leader Warren Jeffs broke his silence Friday, delivering before jurors a 55-minute sermon defending plural marriage as ordered by God and protected by the U.S. Constitution.

Jeffs, 55, is accused of sexually assaulting two underage girls and could face life in prison if convicted. He fired his high-powered defense team on Thursday and has been representing himself, but he made no opening statement and spent hours sitting alone at the defense table staring into space in silence while prosecutors made their case.

That changed, however, as FBI agent John Broadway testified about seizing eight desktop computers and 120 boxes and large folders of documents from the sect’s West Texas compound in April 2008. Broadway was about to describe a list of names and birthdates for those living at the compound when Jeffs suddenly cried “I object!”

“There is sacred trust given to religious leadership not to be touched by government agencies,” he said.

Jeffs is ecclesiastical head of the Fundamentalist Church of Jesus Christ of Latter Day Saints, an offshoot of mainstream Mormonism that believes polygamy brings exaltation in heaven. The church’s 10,000 members see Jeffs as a prophet who speaks for God on Earth….

“We cannot surrender these principles based on the laws of man trying to convince us that our religion is not necessary in practice,” he said, referring to freedom of religion as guaranteed by the First Amendment. Jeffs later added, “this must stop in a land of freedom if all others are to receive a similar guarantee against their freedom of religion being trampled.”

Jeffs said his church has practiced polygamy for five generations and believes it is the will of God, who is a higher power than courts, state legislatures and the U.S. Congress. Jeffs is scheduled to be tried for bigamy in October….

When Jeffs finished, lead prosecutor Eric Nichols rose and said the Supreme Court has found since the 1890s that religious freedom does not extend to polygamy….

Jeffs and 11 other FLDS men were charged with crimes including sexual assault and bigamy.

All seven sect members prosecuted so far have been convicted. They received prison terms of between six and 75 years.

Ame Deal, Arizona 10-Year-Old, Killed By Family For Taking Popsicle: Police

The family of a 10-year-old found dead in a trunk outside an Arizona home initially claimed the child died while playing hide-and-seek. But investigators now believe Ame Deal suffocated after her family locked her in the box because she took a popsicle from the freezer without permission.

Phoenix police claim Deal’s grandmother, aunt and two cousins regularly subjected the child to horrific treatment, ultimately culminating in her July 12 death.
