The Crown Prosecution Service has come a long way in dealing with cases involving violence against women and girls. In the last year (2011-12) we have seen the conviction rate rise to 73%, delivering the lowest attrition rates ever recorded. The CPS has now published a trailblazing report on so-called “false allegations” of rape or domestic violence….

This report outlines the key findings from the review of those cases and the steps that we plan to take. Importantly, what it shows is that charges brought for perverting the course of justice or wasting police time for such “false” allegations need to be considered in the context of the total number of prosecutions brought for those offences. In the period of the review, there were 5,651 prosecutions for rape and 111,891 for domestic violence. During the same period there were 35 prosecutions for making false allegations of rape, six for making false allegation of domestic violence and three for making false allegations of both rape and domestic violence.

Furthermore, the report shows that a significant number of these cases involved young, often vulnerable people. About half of the cases involved people aged 21 years old and under, and some involved people with mental health difficulties. Pope ‘must hand over sex abuse files’

POPE Francis must commit to handing over secret Vatican files about child sex abuse in Australia, an advocacy group for people abused by priests says.
Nicky Davis, of the Survivors Network for those Abused by Priests (SNAP), called on the new Pope on Thursday to show that the church is serious about tackling child sexual abuse.
She said the Catholic Church had never voluntarily handed over incriminating documents or cooperated with law enforcement or official inquiries into the issue.

LA archdiocese to pay out $10 mln to settle abuse cases
13/03/13  With all eyes on the Vatican’s new beginning – the past continues to dominate for the US archdiocese of Los Angeles and its former leader Cardinal Roger Mahony.
LA has agreed to pay out 10 million dollars (7.7 million euros) to settle four cases of sexual abuse by Father Michael Baker. Recently-released church files show Cardinal Roger Mahony knew that Baker, and others, had abused minors – but he allowed them to stay in the ministry. A Lawyer for the archdiocese, Michael Hennigan, denied a church cover-up, although he said Mahony admitted he made “serious mistakes” with Baker. POLICE are probing claims that disgraced DJ Jimmy Savile was filmed cavorting naked in a Satanic sex club.

Operation Yewtree detectives investigating the shamed star’s sordid antics are hunting for the footage which is said to have been preserved on DVD.

The sleazy film is said to show other celebrities and civic bigwigs taking part in naked Satanic rituals at a secret club called The Chamber.

The meeting place in Whitby, North Yorks, had a ceremonial whipping post in the centre of the room. Occult symbols including pentagrams and goat’s heads adorned the walls.

Detectives probing Savile’s paedophile past are to travel to the seaside town to investigate the club….

The bizarre new line of inquiry could lead to more arrests by Yewtree officers investigating links to the ex-Top Of The Pops host, who died in 2011, aged 84.

They will want to establish if all the activities at the club involved consenting adults or whether anyone was abused.

The Whitby investigator, who has not been named, claimed there was “a substantial amount of information” to show Savile was invited to Satanic rituals in the town.

“Someone once made a recording of what unfolded and that film is still said to be in existence in DVD form,” he said.

“From what I understand this was not so much serious Satanic ritual but celebrities and local dignitaries dancing around naked with a Satanic theme going on.”….

Former monk and priest, and now advocate for victims of sexual abuse within the Catholic Church, Patrick J Wall, says sexual abuse of children has been part of the culture of the Catholic Church as far back as 60 AD and despite constant attempts by the Popes to curtain the problem, it has never been snuffed out….

PATRICK J WALL: Well after 12 years in the monastery and six years as the priest, all six years I was assigned to follow perpetrators, I came to the conclusion in my early 30s that if I wanted to be a defence lawyer and to defend child abusers the rest of my life, that was going to be my next 40 years.

And at that point after, you know, discovering that this is just not an isolated phenomena to the diocese or the religious order I belong to, it’s really a worldwide phenomena, I had to pull the plug and leave in ’98….

PATRICK J WALL: Well the pretty constant threat analysis you have to do is after, you know, decades of cases that generally about 6 per cent of the Roman Catholic clergy is going to offend against a child in their lifetime….

EMMA ALBERICI: Why wasn’t your role as a so-called fixer to take the issues to police?

PATRICK J WALL: That was never, ever part of the culture. And that’s why I bring it up with everybody that whether you look at the documents in Los Angeles, you look in the documents in Dublin or you look in the documents in Sydney, they’re all exactly the same. How next pope must tackle child sex abuse

(CNN) — As Pope Benedict XVI steps down, the moral authority and future of the Roman Catholic Church depends on the next pope forcefully dealing with child sex abuse in its ranks.

Benedict had the power to effect fundamental, institutional change from the top that would have protected children of future generations. Benedict failed to change the Vatican’s traditional methods of handling child sex abuse by priests and so abuse of children continued, with thousands of more cases.

Before his installation as pope, Cardinal Joseph Ratzinger was the keeper of the traditional papal secrecy around sexual abuse as the leader of the Congregation for the Doctrine of the Faith. He issued Vatican orders directing cardinals, archbishops and bishops to keep credibly accused priests in ministry, to move them to a different parish or to keep them in the priesthood because they were too young, too infirm or their removal would cause too much scandal for the church.

As pope, he condemned the abuse more strongly than his predecessors, but he did nothing to really change the situation….

I was reading up on President Obama’s hugely ambitious, quite expensive, and yet-to-be-officially-announced Brain Activity Map Project. The first public hint of the project came during last week’s State of the Union address, when Obama, after noting that the federal government’s investment in the Human Genome Project during the eighties and nineties had led to a 140-fold return on investment, declared that “today our scientists are mapping the human brain,” and that “now is the time to reach a level of research and development not seen since the space race.”

Since then, more details have begun to trickle out. The project, which is slated to cost north of $3 billion, is already well into its planning stages, and funding for it will probably be part of next month’s federal budget proposal. A handful of scientists have come forward and revealed that they have been instrumental in the project’s planning. Interestingly, most of these same scientists collaborated last year on an article in the academic journal Neuron. The article is called, “The Brain Activity Map Project and the Challenge of Functional Connectomics.”….

Iran moves to legalize marriage for girls under 10 years old

When Saudi Arabia announced three months ago that girls as young as 10-years old would now be allowed to marry, Iran decided to drop the age limit even further.
Iranian Christian news service Mohabat News reports a member of the Iranian Parliament (Majiles) Mohammad Ali Isfenani, “we must regard 9 as being the appropriate age for a girl to have reached puberty and qualified to get married. To do otherwise would be to contradict and challenge Islamic Sharia law.”

He argues,”Before the revolution girls under 16 were not allowed to marry. Parents determined to get around the law would often tamper with their daughter’s birth certificate. Under the previous constitution, people were legally regarded as adults when they were 18. After the revolution the age at which children were regarded as going through puberty was lowered to 9 for girls and 15 for boys….

A proposal to eliminate the statute of limitations for victims of child molestation to file lawsuits against their abusers has been introduced by Sen. Jim Beall, D-San Jose.

Senate Bill 131 addresses the inability of victims to seek damages because of repressed memories that do not surface until after the deadline to file a lawsuit has passed. Currently, the law states that an action must be filed by the plaintiff’s 26th birthday or within three years of the date that the adult plaintiff reasonably discovers that the psychological trauma he or she is suffering from is linked to sexual abuse. Beall said the law needs to be updated to reflect recent medical findings.

The alleged offences were committed between 1981 and 1989, and involve a former RAF serviceman who was stationed in Berlin at the time.

The Ministry of Defence said yesterday that RAF Police Special Investigations and Intelligence Branch had interviewed a man from the London area….

Crystal Anderson’s friends told her not to call. Don’t get involved. None of your business, they said.

The situation next door, though, nagged at her. Something didn’t seem right with the 17-year-old neighbor boy.

When she first met him in August after she moved into the cluster of townhomes in Kansas City, North, he was outside all day, sometimes until way past dark. But in recent months she’d barely seen him.

Then one day in late January she saw him chained to his family’s basement door. The teen’s stepbrother told her the family sometimes had to restrain the teen so he wouldn’t hurt anybody.

Just to make sure the neighbor boy was OK, Anderson on Monday called Missouri’s child abuse and neglect hotline. She told of how the timid young man no longer walked the neighborhood for hours a day and said she had recently seen him chained. Police were there within an hour, she said. An ambulance followed.

Authorities and child advocates say Anderson was the boy’s savior. She did what too many people, including other neighbors in her Northland complex, have shied away from doing, not just in this alleged abuse case, but in many others.

She picked up the phone.

“That was a lifesaving call,” said Debby Howland, coordinator of the Kansas City Child Abuse Roundtable Coalition. “Too many people don’t want to get involved. But thankfully someone did. It’s as simple as a phone call.”

In Kansas City, this is the third time in eight months that a child has been found locked away by parents or guardians….

The friend of a woman who died after being raped on a bus in Delhi has given his first interview since the incident.

The man, who has not been named, told Zee News how he and the victim had boarded the bus and paid a fare, before he was beaten unconscious by men on board, who then attacked her.

He also criticised police for their slow response to the attack.
The woman died of her injuries last weekend, and five men are due to stand trial for her murder and rape. The five could face the death penalty if they are convicted. A sixth suspect is expected to be tried in a juvenile court.

The friend said the bus had tinted windows, and that he believed the group of men had laid a trap for them. “We tried to resist them. Even my friend fought with them, she tried to save me,” he said. She tried to dial the police control room number 100, but the accused snatched her mobile away.”

He confirmed earlier reports that the assailants had thrown them off the bus and tried to run them over. And he also criticised the authorities, accusing them of being slow to arrive, then arguing over jurisdiction, and eventually taking them to the wrong hospital.

“My friend was bleeding profusely. But instead of taking us to a nearby hospital, they [police] took us to a hospital that was far away,” he said….

Delhi women ‘carry knives’ on board buses  3 January 2013
Indian authorities have charged five men with the kidnap, gang-rape and murder of a woman in Delhi last month.
The 23-year-old was travelling on a bus when the men beat her and her companion with iron bars, raped her for nearly an hour and then threw them out of the moving bus into the street, say police.
The attack has sparked mass protests in India and there have been calls to improve safety for women….

US rape case loophole prompts uproar  4 January 2013
California lawmakers have vowed to close a loophole that allowed a man’s rape conviction to be overturned because his victim was not married.

An arcane state law says a person who gets consent for sex by pretending to be someone else is guilty of rape only if posing as the victim’s spouse.

Julio Morales was initially convicted of rape after pretending to be the unmarried victim’s boyfriend. A similar loophole has already been closed in the state of Idaho.

In the California case from four years ago, Morales went into a room and had sex with an 18-year-old woman after her boyfriend, whom she had fallen asleep beside, had left….

In its ruling on Wednesday, the California appeal court reluctantly decided that Morales was not guilty of rape, because he was pretending to be the woman’s boyfriend and not her husband.  A law dating back to 1872 makes it a crime for a man to have sex with a woman while posing as her husband, but not as a boyfriend….

A response to Jon Henley’s article on paedophilia  Tom Watson MP January 4th, 2013
Jon Henley had a piece in yesterday’s Guardian, entitled “Paedophilia: bringing dark desires to light”. He’s received a furious response on social media and I can see why. Many involved child protection will find it hard to see it as anything other than the commentariat’s backlash, a contrarian response to a public outcry over recent revelations about child abuse by the rich and famous….

My main argument against this article is that this approach ignores the evidence of the experiences of abused children, the experiences of adult survivors of child abuse and the experiences of many professionals who work to protect children. It is a risky strategy at the current time because so many of those who promoted the rights of the ‘paedophile’ have in later years been convicted of sexual crimes against children. Equally, so many of those whom this lobby attacked have been vindicated in their efforts to protect and gain justice for children and survivors….

No wonder many more enlightened academics like Dr Liz Davies talk of the “child sex abuse lobby”. She argues some academic writings have to be located in the context of what is known about those who spread those viewpoints and their agendas. Their views were clearly expressed in a document dated 1975 where Paedophile Information Exchange submitted evidence to the Home Office.This proposed abolition of the age of consent and the removal of consensual sexual activity at all ages from the criminal law….

In order to sexually abuse a child a perpetrator will often groom the child and so it is not uncommon for a child to have some positive feelings towards the person harming them. The perpetrator may also be someone who is close to them and the child wants the abuse to stop but does not want to lose the relationship. This is no way suggests that the abuse is justifiable. In fact a state of confused emotions and responses adds to the severity of the trauma experienced by the child. That this is not obvious to Jon Henley is alarming to me.

Whether or not a child voluntarily entered into sexual relations with their abuser, and how positive or negative they felt about it at the time, is irrelevant when it comes to both the long-term effects of child sex abuse, and how seriously we should treat the abuse. Even if it is true that for some survivors of this type of consensual abuse there were no “undesirable outcomes” (though this is surely hard to quantify), this is certainly not true for all, or even many, if any, children who entered into abusive relationships voluntarily; and to draw a distinction between children who were violently abused and children who submitted willingly is irresponsible and damaging when children who submitted willingly are already more likely to feel shame, self-blame and not seek help due to their belief it was their own fault….

Survivors of child sex abuse commonly suffer from depression, anxiety disorders, panic attacks, phobias, flashbacks, disturbing thoughts, intrusive memories, self-harming, alcoholism, eating disorders, and feelings of shame, anger and worthlessness. This is the reality, but Jon Henley doesn’t voice it in his piece.

123 child victims of Internet sex abuse identified — one just 19 days old, US officials say By Andrew Mach, NBC News
In just over a month, more than 120 sexually exploited children — one just 19 days old — were identified in an international operation that found them depicted in child pornography on the Internet, U.S. officials said Thursday.

In Operation Sunflower, led by agents from Immigration and Customs Enforcement’s Homeland Security Investigation unit from Nov. 1 to Dec. 7, 123 victims of child sexual exploitation were identified, ICE Director John Morton said at a press conference in Washington.

Of that group, 44 children had been living with their abusers, and 79 children were exploited by people outside of their home or were victimized as children and are now adults. Seventy female and 53 male victims rescued; 110 of the victims were identified in 19 U.S. states and the rest were identified in six foreign countries….

Of the victims identified during Operation Sunflower, five were under the age of 3, and one of those was just 19 days old. Thirty others were below the age of 10, officials said….

….The court heard the defendant used the girls as “playthings” to fulfil his own sexual gratification in a “cycle of violent and sadistic behaviour.”
The abuse went on between 1977 and 1984.
Sullivan was arrested in 2009 but went on the run for 22 months before being caught last July. He admitted 25 sex charges, including nine rapes….

Website to boost rape reporting in London 5 December 2012
A website aimed at boosting the number of reported rapes has been launched by the Metropolitan Police. Called My Decision, the site provides a step-by-step guide for anyone who has been raped or sexually assaulted.

It is designed to overcome barriers people may have to reporting such crimes – for example victims fearing they would not be believed. According to the Met only one in five rape victims go to the police and about 40% choose not to report it.

The Rape Crisis charity welcomed the fact the website will give information and answer victims’ questions, but said it lacks links to “crucial support services”….

PORTLAND, Ore. — An array of local authorities – police chiefs, prosecutors, pastors and town Boy Scout leaders among them – quietly shielded scoutmasters and others who allegedly molested children, according to a newly opened trove of confidential files compiled from 1959 to 1985.

At the time, those authorities justified their actions as necessary to protect the good name and good works of Scouting. But as detailed in 14,500 pages of secret “perversion files” released Thursday by order of the Oregon Supreme Court, their maneuvers protected suspected sexual predators while victims suffered in silence.

The files document sex abuse allegations across the country, from a small town in the Adirondacks to downtown Los Angeles.

At a news conference Thursday, Portland attorney Kelly Clark blasted the Boy Scouts for their continuing legal battles to try to keep the full trove of files secret.

“You do not keep secrets hidden about dangers to children,” said Clark, who in 2010 won a landmark lawsuit against the Boy Scouts on behalf of a plaintiff who was molested by an assistant scoutmaster in the 1980s.

The files were shown to a jury in a 2010 Oregon civil suit that the Scouts lost, and the Oregon Supreme Court ruled the files should be made public. After months of objections and redactions, the Scouts and Clark released them….

The 1959-85 files show that on many occasions the files succeeded in keeping pedophiles out of Scouting leadership positions – the reason they were collected in the first place.

But the files document some troubling patterns.

In many instances – more than a third, according to the Scouts’ own count – police weren’t told about the alleged abuse.

And there is little mention in the files of concern for the welfare of Scouts who were allegedly abused by their leaders. But there are numerous documents showing compassion for suspected abusers, who were often times sent to psychiatrists or pastors to get help.

In 1972, a Pennsylvania Scouting executive wrote a memo recommending a case against a suspected abuser be dropped with the words: “If it don’t stink, don’t stir it.”

In numerous instances, alleged abusers are kicked out of Scouting but show up in jobs where they are once again in authority positions dealing with youths.

One of the most startling revelations to come from the files is the frequency with which attempts to protect Scouts from alleged molesters collapsed at the local level, at times in collusion with community leaders.

On the afternoon of Aug. 10, 1965, a distraught Louisiana mother walked into the Ouachita Parish Sheriff’s Office. A 31-year-old scoutmaster, she told the chief criminal deputy, had raped one of her sons and molested two others.

Six days later, the scoutmaster sat down in the same station and confessed.

“I don’t know an explanation, why we done it or I done it or wanted to do it or anything else it just – an impulse I guess or something,” the man told a sheriff’s deputy.

The decision was made not to pursue charges. “This subject and Scouts were not prosecuted,” a Louisiana Scouts executive wrote to national headquarters, “to save the name of Scouting.”

Harriet Harman, the Opposition deputy leader, said the allegations that the late TV and radio presenter abused dozens of young boys and girls had “cast a stain” on the BBC and other trusted institutions.

But at the time Savile was at the height of his fame, Miss Harman was calling for the relaxation of the law on child pornography.

She was a leading light in the pressure group now known as Liberty, which advocated the lowering of the age of consent to 14.

The organisation, then run by the Health Secretary under Tony Blair, Patricia Hewitt, even counted among its affiliates a number of extreme pro-paedophilia groups whose leaders were later jailed.

It means that any independent public inquiry into the culture that allowed Savile to abuse children for so long with impunity, could end up looking into the radical left-wing demands for the liberalisation of child sex laws that were made in the 1970s….

As The Daily Telegraph first disclosed in 2009, in the 1970s the extreme end of the sexual liberation movement included groups who openly campaigned for the abolition of the age of consent. The Paedophile Information Exchange and Paedophile Action for Liberation affiliated themselves to the National Council for Civil Liberties, now known as Liberty.

NCCL complained to the press watchdog about their treatment by tabloid newspapers and in one article admitted it had “plenty of contact” with PIE, and argued that children are harmed by having to go to police and courts after a “mutual relationship with an adult”.

In 1976 the NCCL submitted a response to the Government’s plans to reform sex laws that was dubbed a Lolita’s Charter as it claimed “childhood sexual experiences, willingly engaged in with an adult result in no identifiable damage”.

The organisation said that children as young as 14 should be able to consent to sex, to reduce the “harmful effects of the present laws”.

It went on to say it is “logical” for the age of consent to be abolished but “we fear” it would not be “politically possible”.

Miss Harman, then a newly qualified solicitor, joined the group as legal officer two years later.

In April 1978 she wrote the NCCL’s response to the Protection of Children Bill, which was put before Parliament in order to tighten the laws on child pornography by banning indecent images of under-16s.

It claimed that the new law could lead to “damaging and absurd prosecutions” and “increase censorship”.

She suggested that pornographic photographs or films of children should not be considered indecent unless it could be shown that the subject had suffered, and that prosecutors would have to prove harm rather than defendants having to justify themselves….

Miss Harman left NCCL in 1982 when she was elected MP for Camberwell and Peckham, by which time several members of PIE had been jailed for conspiracy to corrupt public morals.

A spokesman for Miss Harman said: “This allegation is an outrageous slur. Harriet has fought for child protection from sexual abuse over the last 30 years – any attempt to suggest otherwise is untrue and malicious.

The Home Office has been dragged into the Sir Jimmy Savile abuse scandal after it was revealed he was allowed to stay overnight at a school for disturbed girls.

At least five former pupils have told how the DJ abused them during visits to Duncroft Approved School when it was under direct Home Office control.

They claim that the Jim’ll Fix star was given his own flat in the building in Staines, Surrey, by the headmistress in what one victim described as a “paedophile sweet shop”.

The institution for emotionally disturbed girls was under the direct supervision of the Home Office until April 1973, a report in the Daily Mirror claims.

It was visited regularly by government inspectors.

A former pupil Toni Townsend, one of three girls photographed with the star in 1972, told the newspaper: “Jimmy treated Duncroft like a paedophile sweet shop….

“He used to take his pick of the mix. He would wander around the school in a vest and tracksuit bottoms.

“He stayed in a flat on the top floor. He was the only man allowed to stay overnight. Who knows what horrors happened up there.

“The girls at Duncroft had been sent there by the courts for prostitution, drugs and because they tried to kill themselves. Who would have believed us against Saint Jimmy?”

A fellow pupil Carole Wells, now 52, told how Savile once assaulted her in his Rolls-Royce after the headmistress asked if she wanted to go for a ride with him….

Ms Wells said she reported the incident to the head who allegedly did not believe her….

Meanwhile his former assistant Janet Cope told how Savile had an explosive temper that terrified everyone from hospital staff to fund-raisers….
“He thought he was untouchable because he was hand in glove with the hospitals, royalty and the Prime Minister.”

In a previously unpublished interview given by Savile two months before he died, he admitted he was “not a straight punter”.

The Jewish Chronicle obtained a transcript of the interview, which was ostensibly about Savile’s work with Jewish charities, but which included the Jim’ll Fix It presenter’s enigmatic reference to his murky past.

Asked what he would choose if someone could “fix it” for him, Savile said: “A telephone in heaven.”

When he was asked why, he said: “Just leave it at that. That’s the trouble with you fellas, you always want to delve and go further.”

He then added that he was “not a straight punter. “When I’m gone, they’ll say ‘I always thought he was straight but he wasn’t – he was crooked’.”

A key witness in the child sex abuse trial of former Penn State assistant football coach Jerry Sandusky, known in court papers as Victim No. 1, has a book deal and will soon reveal his identity, a publisher announced Thursday.

The case rocked one of the country’s most storied college sports programs and led to Sandusky’s conviction in June on 45 counts of child sexual abuse of several victims. Sandusky is scheduled to be sentenced next month and is likely to receive a sentence that will keep him in prison for life.

Ballantine Bantam Dell said “Silent No More: Victim No. 1′s Fight for Justice Against Jerry Sandusky,” will come out Oct. 23.

The memoir will be co-written by the victim’s mother and psychologist and “will share how he survived years of shame and secrecy, harassment and accusation, before reporting Sandusky’s actions to the authorities, and will offer a hopeful and inspiring message for victims of abuse,” Ballantine said.

SAN ANTONIO — An Air Force instructor convicted of raping a female recruit and sexually assaulting several others cried Saturday as he asked a military jury not to sentence him to life in prison.

Staff Sgt. Luis Walker is among 12 Lackland Air Force Base instructors investigated for sexual misconduct toward at least 31 female trainees, and he faced the most serious counts among the six instructors charged in a sex scandal that rocked one of the nation’s busiest training bases.

A military jury convicted Walker on Friday on all 28 counts including rape, aggravated sexual contact and multiple counts of aggravated sexual assault. Trial judge Col. Wesley Moore consolidated those charges into 20 on Saturday morning, saying some counts duplicated others, but the change did not affect Walker’s maximum sentence….

Five of the women testified Saturday at Walker’s sentencing, saying they couldn’t sleep or maintain relationships with men after the assaults. They said Walker’s actions eroded their trust in authority and affected their performance at work.

“It’s gotten to where I had anger issues even at work,” said one, who had left the military. “If anyone makes even the slightest sexual reference, I go off. I have zero self-control.”….

The women told jurors during the trial that Walker gained their trust to get them alone in his office or an empty dormitory, where he then forced them into kissing, touching or intercourse. The alleged sexual misconduct among instructors at the base apparently began in 2009, but the first woman didn’t come forward until last year. The women who testified against Walker said they didn’t tell anybody at first because they feared being booted from the Air Force…..

According to prosecutors, Walker had sexual intercourse with four of the 10 female recruits. He was also accused of making flirtatious or sexually suggestive comments, sending inappropriate text messages and sometimes groping his recruits.

Chile investigating 61 schools for child sex abuse  July 20, 2012

SANTIAGO, Chile — Chile’s attorney general is investigating 61 schools in the country’s capital for possible child sex abuse….

Attorney general Sabas Chahuan said Friday that his office will look at 49 schools in eastern Santiago and 12 on the capital’s west side. Several teachers have recently been accused of sexually molesting children at day care centers and schools in affluent neighborhoods on the city’s eastern side.

(Reuters) – Pennsylvania’s governor said on Thursday that Penn State University officials may have intentionally withheld information from a grand jury looking into allegations of football coach Jerry Sandusky’s child sex abuse. Penn State’s cooperation in the Sandusky investigation, dating back to 2009, was “incomplete,” despite a subpoena from the state attorney general, Governor Tom Corbett said at a news conference. Corbett was Pennsylvania’s attorney general in 2009, before he was elected governor in 2010….

Penn State failed to turn over all the evidence sought by the grand jury looking into Sandusky, Corbett said.  “It was not initially provided by Penn State University when it was subpoenaed by the attorney general’s office,” he said. “I am very disappointed in the lack of forthcoming evidence to the subpoena that was given to them by the attorney general’s office,” he added.  Pennsylvania newspapers reported that Corbett said that emails implicating university officials did not come to light until after charges had been filed in the Sandusky case.

Penn State spokesman Dave La Torre said that Penn State is cooperating fully with all investigations. “Penn State has, literally, turned over millions of pages of documents to investigators and continues to cooperate with any and all requests for information,” he said.

The grand jury investigation into the case remains open, according to Attorney General spokesman Nils Frederiksen. He would not say whether Penn State might face obstruction of justice charges or if any other charges might be pending….

Penn State also faces an investigation by the U.S. Department of Education, which is weighing whether it violated the Clery Act that requires colleges to report criminal incidents on campus, and by the NCAA, which governs U.S. college sports and is weighing sanctions against the university.

A member and former chairman of the Penn State board of trustees resigned on Thursday, becoming the first board member to do so in the wake of the Jerry Sandusky child sex abuse scandal.

Steve Garban said in a letter his presence on the board had become “a distraction and an impediment” to its efforts to move forward.

Garban, who had stepped down as board chairman after Sandusky’s November arrest but had remained a board member, was harshly criticized over his handling of the crisis that engulfed Penn State, and he faced persistent calls from alumni and fellow board members to resign.

An internal investigation by former FBI Director Louis Freeh found that Garban was briefed twice about developments in the Sandusky case but didn’t share what he knew with the entire board, depriving trustees of a chance to prepare for the worst crisis in Penn State’s 157-year history….

In April 2011, the report said, Spanier told Garban about a grand jury investigation of Sandusky. Garban, in turn, failed to alert fellow board members. Garban told investigators that Spanier downplayed the Sandusky probe, and he recalled his former boss saying, “It was the third or fourth grand jury and nothing would come of it,” the report said.

Then, on Oct. 28, Garban learned from Penn State’s chief lawyer that two university administrators were about to be charged with failing to report suspected child abuse. Garban told investigators he was “astounded” when he saw Sandusky in the Nittany Lion Club at Penn State’s home game against Illinois on Oct. 29.
