Historic Lawsuit to be Filed in Federal Court Against Church and Crown June 29, 2012 Toronto, Canada:

A joint media release by The Association of Citizen Prosecutors (ACP) and The International Tribunal into Crimes of Church and State (ITCCS) is to be released on “Canada Day”, July 1, 2012.

It announces the first class action lawsuit in Canadian history to name as co-defendants the Vatican, the Crown of England, Canada and its churches, and big pharmaceutical companies, all of which are accused of crimes against humanity and criminal conspiracy.

The lawsuit is brought by Jason Bowman of the ACP and Rev. Kevin Annett of the ITCCS, on behalf of a group of many others.

The lawsuit will be explained in detail at a press conference held on the date of filing at the Federal Court Building, on Wednesday, July 4 at 1 pm EST at 180 Queen Street West in Toronto….

Church crisis: Cardinal Brady should face criminal probe says Smyth child victim

A WOMAN, who was sexually abused as a child by paedophile priest Brendan Smyth, today called for a criminal investigation into the actions of Cardinal Sean Brady.

American lawyer Helen McGonigle, (50) who now campaigns for survivors of clerical sexual abuse, said the All Ireland Primate should resign for not alerting other families to Smyth’s horrific catalogue of abuse.

She was molested by Smyth in the late 1960s in Rhode Island, New York.

Speaking to BBC Radio Ulster today, Ms McGonigle said she was “outraged” by Cardinal Brady’s response to allegations in a BBC documentary broadcast this week.

She said Cardinal Sean Brady’s “duty as a human” was to protect children and his failure to act properly on Brendan Boland’s complaint – when he named other five other children being abused – was “unforgivable”.

The Cardinal had shown “arrogance and insensitivity”, Ms McGonigle said.

She was just six-years-old and preparing for the sacrament of penance when she was abused by Smyth, who led her from her classmates into the sacristy of the church where he molested her….

Smyth was already known to have sexually molested children when he was sent to the McGonigles’ parish in the summer of 1965. Using his usual modus operandi, he befriended the family and they bonded over a shared Irish ancestry.

Speaking to the Irish Independent two years ago, Ms McGonigle, who is an attorney living in Connecticut, said: “From 1967 until about 1970 he molested me. He was caught in my parish molesting children as early as 1968….

While any intervention by Cardinal Brady in 1975 would have been too late to save the children of East Greenwich, Ms McGonigle said many others could have been protected….

She said Cardinal Brady must resign and he should be charged with obstruction of justice.

“He sat on this knowledge for 35 years, from 1975 through to 2010, and Brendan Smith continued to abuse children. It is only because of the lawsuit one of his victims has brought that he has had to show his hand.”

….Now an executive director of Amnesty International Ireland, O’Gorman was not satisfied with the similar but weak defence offered by Scicluna and Brady yesterday that back in 1975 Brady was only a ‘notary’ in the interviews.

“Authority is not needed to walk into a Garda station to report the abuse and rape of children. It takes courage and a sense of moral decency,” he said, adding that it was important to remember that Brady was a highly-educated and qualified Canon lawyer at the time. He was also 35-years-old.

Commenting on the atrocious acts of Smyth that spanned a forty-year period, O’Gorman recalls the level of terror still visible in Brendan Smyth’s victims years later as something “extraordinary”.

Professor Perrin Appointed Special Advisor to the Prime Minister

UBC Law Professor Benjamin Perrin has recently been appointed as Special Advisor, Legal Affairs & Policy in the Prime Minister’s Office in Ottawa….

In 2010, Professor Perrin published his first book, Invisible Chains: Canada’s Underground World of Human Trafficking (Penguin Canada, 2010). The book, an expose on the issue of human trafficking in Canada, was named one of the top books of the year by The Globe and Mail.

He has testified before a number of Parliamentary committees studying the issue of human trafficking and child sexual exploitation. In 2010, Parliament adopted Bill C-268, a private members’ bill calling for mandatory minimum sentences for child traffickers. Professor Perrin proposed and helped draft the bill, which was first introduced to the House of Commons in January 2009 by Member of Parliament Joy Smith….

The first known alleged victim in the Jerry Sandusky case, known as “Victim One” was forced to leave his school because of an onslaught of bullying, The Patriot-News reports.

Mike Gillum, psychologist for the family, told the news source that officials at Central Mountain High School didn’t step in and provide guidance to the boy’s classmates, who began to blame Joe Paterno’s firing on the 17-year-old.

Victim One testified he was forced into multiple sex acts between 2006 and 2008. During that time, Sandusky was also assisting the high school with their varsity football program, the report states.

Gillum told The Patriot News that name-calling and verbal threats at the school, which is located about 30 miles northeast of Pennsylvania State University, became too much for the boy to bear.

The Centre Daily Times wrote the 23-page report by a state grand jury investigation alleges that Sandusky molested at least eight boys over a 15-year period, beginning with “Victim 1.”

Neighboring county entangled in scandal

LOCK HAVEN — While most of the attention in the Penn State child sex abuse scandal has focused on State College, the impact extends farther north, where some of the alleged victims of Jerry Sandusky still live….

But from one end of the county to the other, everyone’s talking about what happened at Central Mountain High School in Mill Hall, where Sandusky, the former Penn State defensive coordinator, volunteered as a football coach for three years.

A 23-page report by a state grand jury investigating allegations that Sandusky molested at least eight boys over a 15-year period begins with “Victim 1.” Victim 1 testified that he met Sandusky as a participant in The Second Mile, a charity Sandusky founded in 1977 to help underprivileged and at-risk youth throughout Pennsylvania.

Victim 1, who was 11 or 12 when he first met Sandusky, testified that Sandusky cultivated a relationship with him, buying him gifts, taking him to restaurants and inviting him to sleep over in his basement….

“Victim 1 did not want to engage in sexual conduct with Sandusky and knew it was wrong,” the grand jury report said. Though this discomfort led Victim 1 to eventually break off contact with Sandusky, the report said, Sandusky persisted. An agent for the state Attorney General’s Office testified that there were 61 phone calls from Sandusky’s home phone to Victim 1’s home phone between January 2008 and July 2009.

The grand jury report said that Victim 1 ceased contact with Sandusky when he was a freshman at Central Mountain, where as a volunteer coach, Sandusky had “unfettered access.”

Sandusky would routinely call Victim 1 out of class to meet with him in a conference room, the grand jury report said, and no one monitored these visits. Steven Turchetta, an assistant principal at the school, told the grand jury that Sandusky was “controlling” in the mentoring relationships he established with Second Mile participants and called some of Sandusky’s behavior “suspicious.”

Turchetta learned of the sexual abuse allegations when Victim 1’s mother called the school to report it. School district officials subsequently barred Sandusky from school property and reported the allegations to authorities, as required by law….

Victim 1 has been forced to leave the school because of bullying, the Patriot-News of Harrisburg reported Sunday. Classmates were blaming him for the firing of Penn State head coach Joe Paterno, the newspaper reported.

Children’s Bones Identified at Canada’s Oldest Indian Residential School

A child’s remains and other human bones have been identified at Canada’s oldest Indian residential school in Brantford, Ontario:

Archaeological surveys and test digs authorized by we, elders of the Kanien’keha:ka Nation, have been conducted at the former Mohawk Institute Indian residential school since October 1.

This past week, while on the grounds of the school, our researchers along with Kevin Annett -Rawennatshani, who acts with our approval, have unearthed what has been described as human remains.  One bone among sixteen uncovered has been identified, through preliminary visual examination by a competent archaeologist, as that of a young child. This bone sample is described by the same archaeologist as “definitely human”.

A test dig in a twenty square foot area on grounds adjoining the former Mohawk Institute have revealed a considerable number of bones, as well as buttons which have been confirmed to be part of the children’s school uniforms. Large deposits of coal were also found associated with these remains, all at a depth of barely two feet. Several of the bones have also been cut up, suggesting that the bodies may have been deliberately dismembered, while other bones were broken.

Shock as Catholic bishop who brokered multi-million dollar sex abuse settlement is found GUILTY of importing child porn

By Daily Mail Reporter 5th May 2011 A Roman Catholic bishop has been found guilty of importing child pornography in a case that has sent shockwaves through Canada and the Church. Bishop Raymond Lahey was stopped at Ottawa Airport after border guards found 588 images and dozens of videos of naked boys as young as eight on his computer and phone. He was also carrying a bag of personal sex toys. He was found guilty on the charge today….

The bishop’s crimes are especially shocking for Canadians because Lahey was the public face of an historic apology and $15million (£8million) settlement for victims of sexual molestation by a priest in his diocese….Lahey, who is facing a mandatory 12-month minimum prison term, voluntarily entered custody today. The images and videos will be viewed by the judge in private before official sentencing.
In addition to the criminal charges, Lahey also faces accusations in a civil suit of sexually abusing an orphanage resident in the early 1980s.

The Mount Cashel Orphanage in St. John’s, Newfoundland was closed in 1990 after it was revealed that staff had systematically abused some 300 residents over several decades.

Twenty-five Canadians are among 57 men arrested after authorities shut down an international child-porn network , Toronto police announced Wednesday.
Twenty-five children were rescued, 12 of whom are from Canada, in the year-long investigation into the online trading of child pornography.

Det. Paul Krawczyk, from the child exploitation section of Toronto Police’s Sex Crimes Unit, said 57 people including 25 Canadians were arrested on charges of child pornography as part of a massive investigation known as Project Sanctuary.
A total of 218 charges were laid, ranging from making, possessing and distributing child pornography to luring a child under the age of 16 and sexual assault….

Krawczyk would not discuss the undercover operation beyond saying the suspects were connected by the way they shared the images online. He said there was “hundred of thousands, if not millions, of images.” Police said some the images showed children in their infancy. “There was a lot of very young child pornography,” Det. Const. Janelle Blackadar of the Toronto Police Sex Crimes Unit told CTV Toronto. “By young, I mean, infant, toddler abuse….”

Over the past year, 26 U.S. men have been arrested on 56 charges, 25 Canadian men have been arrested and face 131 charges and six European men have been arrested and face 13 charges.
The Canadian men who have been charged range from 20 to 68 years of age. They face a total of 131 charges after the execution of 31 search warrants across the country.

People rightly shake their heads in disbelief at each halting step that the Holy See makes toward fixing its morally-reprehensible approach to child sex abuse by clergy. Even now, the enormity of the revelations regarding the coverup is still hard to absorb. As readers will remember, it all started with the Boston Globe’s groundbreaking investigative reporting in 2002.

Today, abusing priests in countries around the globe — and those in the Church hierarchy who knew, but stayed silent — have been implicated.
The crisis demands an emergency response of grand magnitude. Yet an institution of the size, scope, and political structure of the Catholic Church is inherently incapable of such movement. Each new announcement falls short of reaching the other side of this chasm of error. Sadly, the recent early reports on the Vatican’s “new” amendments to the canon law governing church trials of child abusers are no different.

These amendments appear to be simply some re-packaging of internal practices, with some clarification. They offer little to reassure those inside and outside the Church who care about children that children will finally, actually be safe.

Vatican knew of abuse in Ontario: Victim – Papal embassy officials told in 1993, says man abused by former monsignor

Mar 28 2010 Sandro Contenta – An Ontario victim of a pedophile priest who later became a top Vatican official says the Vatican knew of allegations against the priest years before he was convicted. The priest, former Monsignor Bernard Prince, was convicted in 2008 of molesting 13 young boys between 1964 and 1984. Most of the incidents occurred in the Killaloe area, near Pembroke in eastern Ontario. He was defrocked last year. Prince was appointed to a top Vatican job in Rome in 1991 – the year after the Roman Catholic Diocese of Pembroke learned of sex abuse allegations – says the victim, who can’t be identified because of a court publication ban on identifying him. The victim says in 1993 the Apostolic Nunciature in Ottawa – the Vatican’s embassy – was notified of the allegations.

Yet Prince remained secretary general of the Vatican’s Pontifical Society for the Propagation of the Faith until his retirement in 2004. “The Apostolic Nuncio in Ottawa was aware of the allegations,” says the victim, referring to the Vatican’s ambassador at the time, Archbishop Carlo Curis. “They did nothing about it,” the victim alleges, referring to Vatican officials. “In fact, they just continued to cover him up.” The victim, now 53, is one of several who have filed civil lawsuits seeking damages against Prince and the diocese of Pembroke. Questions surrounding the Vatican’s treatment of Prince – now serving a four-year prison sentence in British Columbia – come as the Roman Catholic Church is facing a wave of sex abuse scandals in Ireland, Germany, Austria, Switzerland and the Netherlands….

In Ontario, Robert Talach, the London-based lawyer for Prince’s victim, wants the Vatican to come clean: “What did the Vatican know, and did that factor into how they treated (Prince) when he got to Rome?” he asked. Talach has filed 14 separate civil lawsuits against Prince and the Pembroke diocese. He says six have been resolved. The remaining lawsuits each demand $2 million in damages….

Talach has almost 100 clients alleging sexual abuse by priests in Ontario and the Maritimes. The incidents span from the late 1950s to the early 1980s. The way bishops in almost all cases reacted, Talach says, suggests a Church-wide policy: “Stop the spread of the information, move the perpetrator, and with some sort of religious duress, at least, make your best effort to keep the victims and the family quiet, and back to business as usual.”….

“Is that standard procedure – you promote someone who has allegations of sexual abuse against him?” the victim asks….At his trial in 2008, Prince, then 72, pleaded guilty to 12 charges of indecent or sexual assault. He was found guilty on a 13th charge of indecent assault.

Between 1950 and 1974, Murphy stalked his pupils and molested them in cars, in dormitories and, in some cases, even in the confessional — a doubly serious offence under Catholic Church law.

Murphy would tell the boys to confess to sexual activities with their peers. …. Murphy pressured the boys to give him the names of other young sinners, whose beds he would then visit at night. There was no need to be quiet about it, because the boys were all deaf.

In 1974, Murphy was removed from the school “for health reasons” and transferred to a parish in northern Wisconsin, where he apparently continued to have contact with children and adolescents. But the civil authorities also did nothing, and all investigations against Murphy were dropped…..In June 1996, the Archbishop of Milwaukee, Rembert Weakland, turned to the then chairman of the CDF, Cardinal Joseph Ratzinger. Even though it wasn’t until 2001 that the church began requiring that all abuse cases in the global church be reported to the CDF, Ratzinger’s office was responsible, because the “sollicitatio,” or solicitation to commit carnal sin, occurred in the confessional, one of the holiest places in the church. The severity of the case, Weakland wrote, suggested that an internal church trial would be the right approach, a trial that could end in exclusion from the priesthood. Ratzinger didn’t respond. In December 1996, the Archdiocese of Milwaukee informed Murphy of its intention to investigate the abuse cases. Only after a second attempt did Weakland receive a response from the Vatican, in March 1997, in the form of a letter from Tarcisio Bertone, Ratzinger’s then deputy at the CDF. Bertone wrote that he recommended an internal church trial based on the laws of 1962, which protects the participants by applying the “Secretum Sancti Officii,” or secrecy on penalty of excommunication.

‘Kind Assistance’
On Jan. 12, 1998, Murphy appealed directly to Cardinal Ratzinger, asking him to stop the proceedings his archdiocese had initiated. The acts of which he was being accused, he wrote, had occurred 25 years earlier: “I am 72 years of age, your Eminence, and am in poor health. I simply want to live out the time that I have left in the dignity of my priesthood. I ask your kind assistance in this matter.”

His wish was fulfilled. In April 1998, Bertone dropped the case against Murphy, in the spirit of forgiveness. In his letter to the Bishop of Superior, Wisconsin, he wrote: “The Congregation invites Your Excellency to give careful consideration to what canon 1341 proposes as pastoral measures destined to obtain the reparation of scandal and the restoration of justice.” The letter ends with Bertone’s best wishes for “a blessed Easter.”
Murphy died five months later, in August 1998. Bertone, for whom this meant that the matter was closed, wrote to the Archbishop of Milwaukee: “This Dicastery commends Father Murphy to the mercy of God and shares with you the hope that the Church will be spared any undue publicity from this matter.”

BY JAY WEAVER The Archdiocese of Miami, along with top Vatican authorities, knew as far back as 1968 that the Rev. Ernesto Garcia-Rubio, a priest later defrocked amid child sex-abuse allegations, had a troubled past in Cuba before transferring to South Florida, lawyers representing victims claimed Monday. The lawyers say the Vatican’s role is similar to what is alleged in the scandal now unfolding in Wisconsin, where top Catholic officials are accused of failing to defrock a priest accused of molesting some 200 deaf boys in a long career that paralleled the Miami cleric’s.

“It was a longstanding and well-known secret that the Vatican and Archdiocese of Miami knew exactly what Ernesto Garcia-Rubio was capable of,” said Aventura attorney Jessica Arbour who with lawyer Stuart Mermelstein have filed several suits against the archdiocese involving Garcia-Rubio.

But privately Archbishop Edward McCarthy had already insisted that Garcia-Rubio be evaluated for pedophilia, according to investigative records obtained by The Herald. Six months before the paper’s November 1988 story ran, the archbishop told Garcia-Rubio, then on sabbatical in Colombia, that he shouldn’t return to Miami for a visit to celebrate his 25th year in the priesthood.

“I also must insist that following your sabbatical, but prior to your return, you receive a psychiatric evaluation in a setting determined by the archdiocese,” McCarthy wrote him on May 11, 1988…. The complaints against Garcia-Rubio — first lodged at the Sweetwater church — eventually surfaced in The Herald story, which highlighted four sex-abuse allegations by teenage Nicaraguan and Salvadoran refugees from 1983 to 1988. In late 1988, Miami archdiocese officials sent Garcia-Rubio to St. Luke’s Institute in Maryland for a pedophilia evaluation.

A young Mexican woman who escaped from human traffickers has told US special agents how she witnessed babies and children being “sold to order” to US citizens. America’s Department of Homeland Security in Washington says the girl, known only as Maria, had “significant ~information” and possessed a “remarkable memory” of her experiences inside the gang. In an interview with Channel 4 News, to be broadcast tonight, the teenager tells of a cross-border trade in babies and young children, where Mexican and US gangs worked together to supply a demand in the United States. As a result of the interview, US officials and Mexican authorities have begun an investigation into the alleged trafficking….

Since the 1990s, thousands of women have disappeared from the town. Hundreds of bodies bearing signs of rape and sexual mutilation have been dumped on waste ground in the city; thousands more have never returned. In 2009, 55 teenage girls vanished in the town, which has been gripped by violence as two drug cartels fight a lethal turf war over cocaine smuggling routes into the US….The US state department estimates that more than 20,000 young women and children are trafficked across the border from Mexico each year. Kevin Annett, human rights activist beaten in Vancouver on Wednesday, released a new article today exposing the role of Canada’s police and churches in sex crimes and child trafficking, including the abuse of Native women and children.

Kevin Annett, a community minister, was assaulted by two men in Vancouver’s downtown eastside on Wednesday, Jan. Jan. 6, 2010,  just two days after he published an article on church and government complicity in child trafficking on Canada’s west coast.

Annett suffered cuts, bruises, and at least one broken rib as a result of the unprovoked beating by two men, one of whom is linked to a downtown church agency.

….Annett has exposed the rape, torture and murder of Native children in Canada’s residential schools, through church documents and interviews. In one case, a Native girl was raped and the infant she gave birth to was thrown into the furnace. The abuse of Native children in Canada’s residential schools mirrored the abuse in aboriginal boarding schools in Australia and BIA boarding schools in the United States.

Annett is now exposing the role of the church and Canadian government in sex crimes, including the disappearance of Native children in child trafficking and murder of Native women.

Annett, who for fifteen years has led the campaign to bring to justice the churches and government responsible for genocide in Canada’s Indian Residential Schools, made international news in October 2009 when he held the first memorial service for missing native children outside the Vatican in Rome.
